Have you experienced marital stress or breakup, or medical or psychiatric illness because Canada turned you and your family over to a foreign country — or because you were afraid and entered into IRS compliance and suffered harm, or because you are in “hiding” and can’t afford to be IRS compliant or to renounce? Be a witness.
No single witness will be “perfect” from a litigation point of view. We will be seeking more witnesses (almost) right up to the time of submission of court documents. Your specific situation, that we cannot predict, might have unique characteristics that would be helpful in the lawsuit.

FOR THOSE CANADIANS WHO ALREADY VOLUNTEERED: Unless you have already been informed by me or by our legal team that you will not be a witness, there is still the possibility — or (for some) likelihood — that you will be asked to be a witness. I’m sorry but I cannot estimate the time it will take for our legal team to get back to you with their decision. This is because they need to “mesh” the characteristics of all of the necessary witnesses and testimonies with the actual detailed submission that contains the entirety of their evidence, which are all still evolving. Please be patient in our getting back to you with a decision. Thank you for your help.

Is a form letter that’s been “personalized” still a form letter? Ok, perhaps not from the Minister herself, but she has no doubt given her staff direction on how to respond.
I personally expect more than a form letter coming back, unless the RM’s office comes up with one for the many people clamouring to know whether our banking information has been sent to the CRA. How many requests like that do you think she’s getting? Very few, imagine. I would think the information the CRA gave her in response to my query is being assessed by the government’s legal counsel as to whether it harms the government’s position “before the courts” or assessing the CRA’s privacy needs.

BB, I do actually think my letter was personalized. Like EmmBee, I no longer recall what I wrote to her seven months ago, but she assured me that my (Canadian born) children’s investment accounts would be free from US taxation, which leads me to believe that I must have included in my letter to her some mention of the fact that my kids would be barred from opening a TFSA. I wish somebody here at Brock would do a couple of calculations. First, what are the projected compound earnings over 30 years or so of the renunciation fee, I.e., what could that money have been turned into if it had been invested instead of handed over to the US government, and second, assuming a maximum contribution, what are the projected losses over the same time period to our tainted children who are barred from opening a TFSA, I.e., what is the 30 year penalty of being denied access to a TFSA. Compounding investment can be a really powerful tool, and extending the financial consequences of a ban on a TFSa through time would really give some substance to what is, I am sure, considered a minor problem.

You absolutely should get a specific response to your very specific question. (I hope others asked too.) You are spot on in assuming that this response is being carefully crafted by government lawyers. (Our tax dollars are hard at work there.)
We eventually have to give up asking questions which will never produce satisfactory answers. We need a resolution which means repeal of the implementation of FATCA on our sovereign Canadian soil. The legal challenge is our best hope. Surgite!

We must be prepared to continue resisting well after the court challenge is over. We may see it go down in flames, but even if it is a win, the financial institutions will be caught between a rock and a hard place, so I expect other nefarious ways will be found to appease the USG for relief, these guys won’t go down so easy.
The bigger problem is that no matter what happens to the IGA here in Canada, the USG will continue to seek out and persecute “US persons” though out the world, and that will still include seeking out “US persons” in Canada however which way they can.
If you look at other struggles against mass discrimination, you will see they all have one thing in common, and that is a very lengthy struggle, with many pitfalls along the way.
I will continue to advocate that we all take a hard stance, that we refuse to collaborate in every way possible until the USG gives up on its attempts to enforce CBT. Collaboration guarantees continued enslavement and servitude, and will make the struggle much more difficult and lengthy for those who are trying to break free.
