How would you challenge FATCA if you were a world leader?
As “US persons” abroad there is one thing that we all have in common: we are all vulnerable to the US government and subject to the whims of politicians and a tax code from a distant foreign country, who do not represent us as overseas citizens yet still subject us to their laws as if we lived there. Many of our own countries are busy lining up to sell us out (“us” being dual citizens and “US person” permanent residents) as quickly as they can to the US government.

Letters from IRS starting to come in
Yesterday I received a computer-generated letter from the IRS regarding the first of four 1040 returns I sent in mid-December. I check the mailbox everyday, thinking the notice from hell may arrive, though I really did not expect to hear a word for months. So I wondered before opening it, am I about to lose my sense of calm gained by renouncing and trying to focus, at least occasionally, on something else. I posted a bit about this yesterday but was unable to copy/paste the letter; Petros asked today that I include it in a new post.

Letter from the IRS
For those of you thinking about filing US income taxes for the first time, I suggest you read the following letter that I received from the IRS in the mail today. I sent my zero return for 2009 last week with a letter explaining why it was late (evidently it did not arrive on time to prevent this mail out). I am on the IRS radar, because I was compliant for about the previous ten years. Moreover, they are apparently aware of certain securities I traded in the US. But I didn’t owe anything on my income tax return. So this is the trouble that they will go to harass Canadian residents who are late filing.

My letter to the IRS
This is my letter to the IRS explaining why my 2009 tax return is late. I felt I owed an explanation, since they sent me a little while ago a letter demanding that I file my overdue return and send a questionnaire with my return. The questionnaire did not cover the bases. So I will send the following letter with it. What I want to see is if they will honour their agreement with Jim Flaherty, not to charge late charges.
