@Rev Susi, well if they do it won’t include me then because I’m one of the lucky exempted ones. I know some people here though have been mentioned on the list, but whether they are all “covered” I don’t know.

I was on the list, despite a) not being a covered expatriate and b) the list coming out months before my 8854 was actually due.
At this point, your guess is as good as mine as far as what the list is, does, or represents.

I am going to ask for a copy of my I-407 form by freedom of information act. Has anybody ever heard of forms being deleted. They ask on the freedom of information form it gives you the choice of choosing between;
I am no longer a permanent resident or I am a permanent resident they then have at the end of the form that you are subject to USA perjury charges. I am no longer a permanent resident but I do not have the I-407. If they delete the I-407 form they can say I perjured. They can try to extradite you and take all your money. How will a Canadian extradition hearing view the manner?
US citizenship and TAX are so synonymous, that now there is a Forbes article explaining that Snowden will still have to file and pay US taxes from Russia, and file the FBAR, etc. They can strip him of his passport, but force him to remain a US citizen forever unless he renounces at a US consulate or embassy.

But what if he never comes back? As in ever? That doesn’t matter. Not wanting to return to the U.S. is not the same as not wanting to give up citizenship. There is no time frame that applies to loss of citizenship.
For now, Snowden remains a citizen. And so long as he remains a citizen, he is subject to our laws – and that includes our tax laws. He still has to file and he still has to pay any applicable tax. Goldstein agrees. But, he chuckled, “Good luck trying to collect it.”…?

CBT is suspect is only one of many things Snowdon didn’t think or know about before he split. Whoever hires him will have to pay him in cash, unless Russia says ‘no’ to FATCA, or he finds a financial institution that’s outside its reach.

It’s been mentioned here a couple of times that back in the day there may have been an oath of allegiance to Canada on the passport application form.
I sent an Access to Personal Information request and obtained a copy of my passport application form from August 1976. Unfortunately, there is no such oath. 1976 was my first passport application.

I am thinking Money is stressing out big time, just like most of us did while still in the ‘can’t believe this is happening to me; when will I wake up and find out this is really just a bad dream?’ phase.

WhiteKat I appreciate your concern for Money but he has nothing to be worried about. The IRS is in total disarray and will not be bothering with ex green card holders living in a foreign land. Just ask Em if they have bothered answering her.

I know for myself, I sometimes like to ask hypothetical questions knowing that often times there’s someone out there who knows the answer. It comes from wondering what the worse case scenario would be in a certain instance. Just like our concerns about the Reed Amendment are are unlikely, they certainly aren’t unfounded. Until a law is off the books, it can be picked up and dusted off at any time.

USCIS hasn’t responded to my application for an I-407 (sent 16 months ago) and the IRS hasn’t questioned my not filing … YET … but I am in the system and they know where I live so I can tell you it is disquieting to say the least to have the potential to be classified as a tax criminal and face the possibility of losing my bank deposits to IRS thievery sometime in the future (slim as that possibility seems to be at present). The USA gets meaner and more manic every single day. I will watch over the next few years as other Brockers and eventually my husband get CLNs and gain their freedom but it looks like I will never have any official document in my hand to say my ties to the USA are severed. I did a self-severance and now I have to hope that Flaherty’s promise isn’t trumped and dumped by a USA-Canada IGA. I EMpathize with Money.
I have booked an appointment at US consulate a number of days away. I want to do this before first letter from IRS expires (my story is in expat taxes). I want to request for notarial services. see if I can get my old Social Security number. I am considering sending the number to the IRS thus eliminating the possible penalty for not correct TIN. In this case I would then not file USA taxes or file taxes and not pay. Remember I have never been a US citizen just a green card holder thrown out 30 year ago signed I-407 5 years ago. But I have misplaced it
I have been trying to get a US Immigration lawyer and they are hard to get before date I finally got one the afternoon before schedule. In addition they may be influenced to follow US law I am only concerned about Canadian law and not being extradited.
1) Under the Canadian court system would the revenue rule protect me from not filling?
2) Can the consulate confirm green card is no longer valid?
3) Can the IRS talk to Canadian banks about me not owing US taxes remember the guy who got frozen at TD Waterhouse?
4) Is there anyway they can arrest me at a Consulate for not filling taxes after I-407 as filled. They never gave me any papers to send?
I entered US a few times after signing I-407 my Canadian passport stamped the last 2 times
I will send in a freedom of information request on my alien file marked the box as I am not a lawful permanent resident.
I have seen numerous comment to ignore it but I would like to get rid of the most direct threat regarding not having correct taxpayer id. This issue is causing me a lot of anxiety.
I rather face bad consequence now.

Money. You are being paranoid. US law does not apply in Canada. Cancel your appointment before it’s too late. On the other hand, they won’t have any idea what to do with you so maybe it won’t be so bad. Just don’t waste any money on lawyers.
Can anybody please comment on idea at 1:14. I am not eating. I am completely indecisive. I even afraid of sending an G-639 form to USA. Where I state, I am not a permanent legal resident for fear the USA will extradite me for perjury because I do not have my I-407. I know it is not rational, but fear is griping. I do not have a lot of happiness in my life, The last few year, where I lived in a basement suite and biked for 4-5 hours a day, is the best it has been
Most of my net worth is unrealized capital gains or RRSP it gives me a modest income but I would have to sell it all to pay Canadian taxes, FBAR and US taxes f I am extradited for not having Taxpayer ID. I am a peace of mind person and this is driving me to the wall. I have zero interest in visiting USA and only starting going there because of that damn stupid survivor rights condo. I beat myself up about losing that I-407 and other decisions.

I did cancel the appointment with US consulate 2 hours ago, but I will talk to an attorney about how best to get an I-407 copy. I even spent $60 today to notarize the G-639 but I will not send in until I talked to lawyer next week.
I am have had a lot of crummy things happen, to me so this make feel the worse will always happen.

Em Why do you make him feel worse than he already does? As you well know, you have nothing to fear.
Money What makes you think they have the time or resources to worry about/ go after you? They don’t. Sleep easy. Move on. The more you learn about all of this, the more free you will be. They only have resources to bother wealthy people living in the US and those silly enough or frightened enough to jump into the net. In your case, even if you were to jump into the net, they wouldn’t bother you because there is nothing to be gained for them. Do you have any idea how much, in dollars, it would cost them to bother you? It is not possible. -it isn’t going to happen.

I have no idea how I made Money feel worse. It wasn’t intentional. I would like to have an I-407 in hand just like Money. Money has a chance to get a copy of a lost I-407 but I hold out little hope that my application will ever be processed, officially stamped and returned to me. If the FATCA train picks up speed in the future an I-407 will be as helpful as a CLN at the bank. My US connection is just too easy to discover I’m afraid.
