EmBee suggested that it would be good if there was a thread for new articles, so that people would be aware of where to comment. So, I created this permanent page.  You could mention such articles in the comment stream for this page, or if I see one on another thread, I can copy the link to here. I’ll keep adding to the list, but not deleting, so we’ll end up having sort of a  “bibliography” of FATCA/CBT articles.  [Note:  Some articles are not open for comments]

Note also: JC suggests to see #FATCA on Twitter for latest breaking news. JC finds that is quite a good source and there even are some international articles that one may read using Google Translate.” Others may help certain tweets and articles remain in elevated position by retweeting them.

    (a) a guy who tried to go to OVDI, got booted out, and then had everything he said used against him in a court of law

    Second, the guilty plea of Mr. Cambata has several interesting features. He only pleaded guilty to filing false tax returns for 2007 and 2008, and it is unclear why his plea did not include subsequent years given that, according to the press release, he moved his funds to a third Swiss bank account in June 2008. It is possible that Mr. Cambata properly reported his foreign accounts beginning in tax year 2009 and thereafter. In February 2009, the U.S. government announced its landmark agreement with Swiss banking giant UBS, and the significant publicly generated by that announcement may have prompted Mr. Cambata (like many others) to properly file U.S. returns and FBARs starting in that year and thereafter. In addition, the tax years of conviction (2007 and 2008) would normally be closed due to operation of the six-year criminal statute of limitations for tax crimes, but that statute does not run when the defendant is “outside the United States.”

    I don’t think we will ever get a popular vote in our favour. So then objectives may be to build the community here and that should help fund the lawsuits. Build awareness of The Isaac Brock Society.

  8. Pretty positive BBC article. The Rangel comments are unbelievable:

    “The overall purpose of the law is to detect, deter and discourage offshore tax abuses through increased transparency, enhanced reporting and strong sanctions,” said a spokeswoman for Congressman Charles Rangel – one of those who introduced Fatca.
    “The US Treasury worked tirelessly to address many of these problems, and most have been resolved. If there are still problems with the law, then I believe Congress should hold hearings to see how it can be improved.”

    What a bastard. did he pay 27.5% of the value of the house he rented out abroad without declaring the income?

  10. This US citizen was living in the US. Nothing phantom about his gains. He has to pay US tax , as he should, since he lives in the US. Capital gains taxes are relatively low. The £ has fallen . He won’t pay much.

  11. It’s CGT on a property that is not the main residence, which seems to be about 25%. That’s why all those NRI Indians are getting burned on their property dealings.

    You can say that again. I wonder sometimes who these people are. There is something about the personality of the pro-CBT I have met in person that I can’t quite put my figure on. They are much less open. Is it authoritarian personality syndrome perhaps? “a cluster of personality traits reflecting a desire for security and order, for example, rigidity, highly conventional outlook, unquestioning obedience, scapegoating, desire for structured lines of authority.” People with this syndrome tend to see the world as a dangerous place and like the tried and true. Presenting them with facts that contradict their established beliefs makes them feel threatened and they dig in their heels. Punishments work in bringing them into compliance generally, but not with anti-authoritarians.
    Unfortunately, these authoritarians can usually only be persuaded by a notable authority figure.

    I’ve always liked Nigel Green and his forthrightness, but I have to disagree with his premise that one shouldn’t feel forced to give up U.S. citizenship over FATCA until all the options have been fully explored. What options does he have in mind? Getting into a time machine and going back to an era when overseas Americans weren’t treated like runaway slaves? Perhaps simply giving-up and returning “home” to a country you haven’t lived in since you were in diapers – or ever? Allowing your non-American spouses’ financial records to be handed-over to an insolvent and increasingly hostile foreign government, and passed-around to any three-letter intelligence or enforcement agency that might be interested – with no due process, recourse or oversight whatsoever? He, better than most, should understand that it is now absolutely impossible to live a normal financial life as an overseas American – unless one is already so well-off, like the majority of Mr. Green’s clients, that FATCA becomes a mere annoyance rather than a life-altering catastrophe.

    For those lower and middle-class souls with American taint simply trying to eke out a living beyond that corrupt and tarnished City on the Hill, there really is no other choice than to try to ditch their kryptonite U.S. passports as quickly as they can – if they can – and to count themselves as one of the lucky ones if they have another country they can actually call home. But sadly, even that is no guarantee of being able to live-out the rest of one’s life in peace since no country is any longer safe from the imperialistic overreach of the American Empire. Without a single shot being fired, most nations have already quietly capitulated and lost the FATCA world war, surrendering their sovereignty and their economic destiny to what is now indisputably the greatest tax haven on Earth. Why, in the face of such audacious hubris and hypocrisy, would there be any value attached to a U.S. passport, except for the $2350 USD it now costs to dispose of one?
