UPDATE for Canadian FATCA IGA Lawsuit in Federal Court: Plaintiff Change
This update is to let you know that for health reasons, Ginny, one of our three Plaintiffs, has withdrawn as a Plaintiff in our Canadian FATCA IGA legislation lawsuit.
We are so grateful to Ginny for having been being a part of our team for so many reasons. Her good humour, wit, and wise counsel based upon her experience as an attorney has helped us get through many difficult days during the litigation. She was one of the very few who never had any doubts whatsoever about taking on the personal risk and hardships of being a Plaintiff in a lawsuit against the power of her own government. She provided a service not only to us, but to the entire community worldwide harmed by compliance of their own countries with the foreign FATCA law.
Plaintiffs Gwen and Kazia, the ADCS Board, and our supporters are indebted to Ginny for the sacrifices she and her family have made and we all wish her the very best.

I feel awful to try to make a suggestion that must have already been considered, but I still have to ask. Did anyone try a motion in court to let Ginny remain as a plaintiff but be left alone for a long time to heal?
Even some US courts sometimes recognize the impact of health conditions and sometimes allow extensions to statutes of limitations. Not for me but for occasional others. Me, I’m postponing heart surgery for the third time now, violating doctor’s orders, because I have to meet a statute of limitations in the US during the next few days. But I can’t bear to give in to the thieves. The stress is too much either way, if I fight or if I give up.
My heart goes out to you, Ginny, for having to make the tough, tough decision that this must have been. I wish for your complete return to health with my deepest thanks for your leadership and service to our just cause.

Thank you to the committee, plaintiffs and commenters for your kind words, thoughts and prayers.
Raising my Hermione Hand in hopes of becoming a plaintiff was the easy decision. It has been an honour to serve in that capacity. Accepting the advice of my family and health care providers to resign from my position was a difficult but necessary decision.
There is no one who is irreplaceable, and I leave you in the good and dedicated hands of plaintiffs Gwen and Kazia.
I have enjoyed the many associations and friends I have made here. ( @ George, I look forward to that fish and chips dinner with you some day.) I was humbled when people reached out to me in emails and comments through the years and hope any words of encouragement or information I was able to provide were of help.

Dear Canadian Ginny,
No matter what you say, you ARE irreplaceable. Your possession of an inside track to the workings of the Canadian justice system, your ability to explain this system (in plainspeak) to all of us eager to try to understand it and your outstanding character as a person of honour, courage and sometimes impishness simply cannot be duplicated. We’ve been privileged to have you push the lawsuit as far down the road as you have and are truly sorry you can’t continue but we want you to take care of your health because that is most precious of all.
I hope with all the work you put into your submissions that they can at least be entered into the court record somehow but, as usual, I don’t know how that works. Maybe they already are on record.
Many thanks to you, Ginny, and we will all “Surgite!” because our cause is just.

Dear Canadian Ginny,
Hope and pray you have a speedy recovery. I do believe much of your health problems (I don’t have specific details as to your health problems) started with stress of being a US citizen. Stress is the leading cause of many diseases as I know I have my own health issues due to extreme stress of being a US citizen. No wonder many US citizens are now renouncing in large numbers as US govt does not want productive citizens only welfare recipients. Most of us are not rich but middle class trying to live our lives overseas and are harmed by extra territorial law that scares every bank and financial institutions around the world.

I don’t know if I can say anything as well as what has already been said here.
Grateful thanks for so much you and the others have given us – all your contributions, your time and energy, advice, comments, participation, and first and foremost for having put yourself and big parts of your life and that of your family on the line – altruistically making significant personal sacrifices and putting up with unwarranted intrusion into your personal affairs ( an unwarranted and lengthy torment enacted by our own Canadian government acting as a craven and shameful local proxy for the sole benefit of a foreign nation – while ab/using our own Canadian taxpayer dollars in order to defend the indefensible FATCA IGA against the very citizens and residents it is sworn to protect and serve) for the benefit of others – many of whom may never even have heard of FATCA and FBAR and US extraterritoral CBT, and many of whom may not need to in the future if all combined efforts are successful in opposing the arrogant extraterritorial incursions of the overweening US and its attempts to subvert the sovereignty and autonomy of other nations and people living outside the US.
The toll on the health and wellbeing of you and others in this righteous endeavour is another mark against the Con traitors who used their majority to cede Canada’s sovreignt via the IGA, as well as the gLib hypocrites who initially opposed the foreign FATCA and and now defend our subjugation to it.
I will be thinking of you dear Canadian Ginny, and send my hopes that you recover, and conserve your health and wellbeing.
