Dear Speaker Ryan, Majority Leader McConnell, Rep. Brady, and Sen. Hatch:
As free-market and taxpayer protection organizations representing millions of Americans,
we urge that repeal of the Foreign Account Tax Compliance Act (FATCA)βa plank in the
2016 Republican Party Platformβbe included in any tax reform package sent to the
White House.
Since FATCA’s introduction, Americans living overseas have lost access to their banking
and investment accounts as foreign financial institutions drop clients rightly perceived as
toxic. This has not only impacted the welfare of the estimated nine million Americans
who live and work abroad but hampers small businesses owned and operated by
Americans attempting to compete internationally
FATCA repeal bills will soon be introduced in the House and Senate. We urge the
leadership and committees of jurisdiction to include this vital correction of misguided
enactment of the past administration by including it in any forthcoming tax bill

Oh this is so good, double-plus-plus good. π Jim Jatras wanted this kind of lobby right from the get-go but the financial institutions with the money and power to make it happen chose compliance over defiance.

Repealing FATCA would be great for people who have been prevented from dealing with non-US banks in their country of residence and maybe those with signing powers in non-US companies, but would be a small win compared to the impact of repealing Citizen-based Taxation(CBT). On the positive side, the repeal of FATCA would make it harder or impossible for the US government to enforce its tax and reporting rules for overseas US persons, but such rules would still be in place, and only a switch from CBT towards Residence-Based Taxation can change that.

But, I do agree with fn0 that CBT has to go as well. Without FATCA I will be safe to bank as I see fit in my own country once again. But life will not be the same as it was pre-FATCA. FATCA taught me about CBT and now I KNOW that in the United States I am considered a law-breaker. Until CBT is in the trash heap I cannot dare to cross the border to see my friends and family.
Jim, Nigel, Keith: if you’re reading Brock these days PLEASE put the anti-CBT bee in Congress’ bonnet. It is the cornerstone of the whole problem. Without it FATCA is completely emasculated.

Right now I’d happily settle for ditching FATCA and returning to the status quo ante – CBT on the books but widely and easily ignored.
I’m thrilled to see that the author of the article from Americans for Tax Reform agrees that CBT should accompany (or, at least, follow) FATCA to the grave:

Our founders wrote into the constitution that revenue to run the government be derived from tariffs and duties. In today’s language that id tariffs on imports and sales taxes on goods within the country. When Marxism was sweeping the earth, before it failed wherever tried, a dedicated group of Marxist’s lied to the American people to get them to support amending the constitution to allow congress to pass an income tax. Taxes on income had been prohibited but now with the 16th amendment passed in 1913, the Marxist were like the proverbial camel, who got his nose under the tent then pushed his whole body inside. Social Engineering was not far behind. Before long they were able to vilify the rich and define rich as anyone who had or was making money. FATCA was not far behind. The Marxist politicians think all those who work should now loose over half their income to those who do not work and the only way we can stop that and make us all free again is to Pass the FairTax.
If the 9 million Americans who live abroad wants to ever be free of excess taxation they must help us who stayed home get the FairTax bill Passed, but I never see anything written by contributors to the Isaac Brach column even mention the FairTax.

That’s probably because most people here actually don’t have a big issue with paying an income tax to the countries in which they are resident. And those countries are not the US. (I personally don’t give a flying fuck what the US does to tax its citizens within its borders – I don’t count myself among them, it’s not my affair.)
Also, and don’t take this personally, anyone complaining about “Marxists” in 2017 isn’t doing their credibility any favours.
We all have our stock routines here. Mine is to always advise pragmatism and realistic assessment of risks. Others go on endlessly about corrupt IRS employees never being punished. Yours is to always write a paragraph about Marxism, the Constitution, and the Fair Tax. We all have our individual soapboxes. The satisfaction comes from posting – it’s fun and it costs nothing – but don’t expect anyone to listen.
The Hill has latched onto this news but be prepared for the homelanders making the usual righty-lefty, US-lofty uninformed comments.

Reference to Marx may be far more relevant than you realize. A childhood friend of mine is a high school teacher in the US. When I tried to explain our issues to him, he interupted with, “From each according to their ability and to each according to their needs”. So I asked, are you are Marxist? With a confused expression on his face and a defensive tone to his voice he answered, “No”. “Then why are you quoting him as the reason for taxing me in Japan to pay for your schools in the US?”, I asked. He gave his trademark nervous laugh that he uses whenever asked a question he does not know the answer to.
Whenever I talk to homelanders about CBT, FATCA and FBAR, they invariably bring up their needs and our (belived by them) ability to pay. They do not know they are aspousing Marxism, but espouse it they are.

Glad you don’t have a heart condition. π I’ve weighed in on the side of the anti-FATCA lobby but only a smidge. Others have done much more — go PastBeyond60!!! The numbskulls don’t realize that after over 5 years of reading their venom we are pretty much immune to it. It is quite tiresome but if ignorance is their bliss then so be it.
I think my one or two line zingers are very complimentary to PastBeyond60’s more detailed, informative responses, don’t you? I’m just not in the mood to school these boneheads. Thanks for the extra effort PB60, EmBee and others have made to educate homelanders.

I’m gratified to hear of this, however for my wife, though, it’s too little too late. She’s going after her Canadian PR Card (haven’t had the money to get it until now…) then after that it’s Canadian citizenship – she’s already qualified for time in country. (We’ve been married almost 17 years).

And here it is again! Over the last couple of days I have been arguing with a homelander claiming to be a conservative (Has a pic of Reagan for her avatar!) who is using the exact same arguements that self avowed liberals have used with me. Reapeatedly, I have told her that for me, it is not about taxes as I do not earn enough to owe any to the US. She closed her latest, just a few minutes ago, with the following:
“7. You already said you don’t make enough to pay taxes. You know who funds that consulate you use? I do. I pay taxes. So, if you get penalized because you think you’re a special snowflake who doesn’t have to follow the rules, I’m okay with that. Time you paid your fair share. And since the US has given Japan more than 7 trillion dollars in aid since 1946 and you directly benefit from that, it’s only fair that you help pay for it. Over here, we have to pay for our roads, bridges, buildings and other infrastructure. Why should YOU, an American citizen, get off scott free? Suck it. Renounce. Hurry. We have enough whiners around here. We don’t need to be dealing with ones overseas as well.”
Notice, among the other garbage, is the ‘we need, you pay’ mantra.

Congrats on reaching the next step to free your family from this! It is with happiness for you and sadness for my country, though I am currently enraged at it and many of my fellow citizens, I still do love it, though I am increasingly wondering if it is a past and faded glory that I love and not it in its current state.
