March 8, 2016 UPDATE: Legal fees paid — on to Federal Court for Charter trial contesting Canadian FATCA IGA legislation.
Canadians and International Supporters:
You came through once again: $594,970 for legal costs have now been donated and our outstanding legal bill is finally paid off.
Thanks especially to those who donated even though they never had any “spare” money to give, and despite this gave over and over and over again.
This last round of fundraising also shows that our Canadian lawsuit remains dependent on the kindness of our International Friends: There would be no lawsuit without their financial help.
Know that a very generous donation (today) from a supporter in the United States made it possible to pay off the remaining legal debt. Also please appreciate that there would be no lawsuit without the help of the Isaac Brock Society which has kindly let us use its website to solicit funds.
Our next step is the Constitutional-Charter trial in Federal Court.
For this we need more Canadian Witnesses, and my next post will be devoted only to a request for Witnesses willing to go public, like our Plaintiffs Ginny and Gwen.
For the future: I want a win in Federal Court — and I want the new Liberal Government not to appeal that win.
Thank you all for your support,
Stephen Kish,

Perhaps why a UK legal challenge may succeed. The Canadian lawsuit is more like a US constitutional challenge (the Charter), however, with a UK challenge, because the UK has no written constitution, the UK Supreme Court will take other international challenges into account – like a successful Canadian Supreme Court victory?
http://www.theguardian.com/commentisfree/2016/feb/14/antonin-scalia-america-supreme-court-judge-us-constitution
‘Anyone who reads a UK supreme court judgment will find it cites rulings and judgments from not just the European courts but also, frequently, the US and other courts too. Scalia would have none of that internationalism. His jurisprudence was wholly American; only American judgments could be considered, he believed. In this he both spoke for and gave a huge boost to this exceptionalism, with immense consequences that have reached far beyond the courts.’
What happens in Canadian Supreme Court could impact in a legal challenge in the UK. So UK donors the donations do count for the UK as well.
Only U.S.A. judgments apply, because the boundaries of the U.S.A. are the boundaries of the U.S.A. Canada shouldn’t force banks to comply with FATCA for the same reason. Registering for a GIIN requires designating a FATCA responsible officer, who is subject to the laws of the U.S.A. whilst working in Canada.
Rocco Galati: Canadian Constitutional Lawyer suing the Canadian Government over Bank of Canada , a Public Bank created for the express use of Canada and Canadians with interest free loans to build infrastructure and aid Canadians to recover from the Depression. The Law of the land is that the Bank of Canada exists to aid the Canadian people and institutions and government with interest free loans to further the strength of the country , Canadians and the sovereignty of the nation. Since Pierre Trudeau gave it to the IBS for it’s use, Canada has been paying interest on loans insisted on by Foreign private banks owned and run by those whose only interest is personal profit.
IF you have not heard the interview from Rocco Galati on C2C last night from Toronto or you were unaware of this lawsuit to return Canada’s bank to Canada’s control you are in for an eye opener.
Answers to many questions we have about the Government of the Day , regardless of political stripe and why we have deafening silence from those who pledged to the Canadian people their governing would be different in crucial respects from the Conservative government:

“The Law of the land is that the Bank of Canada exists to aid the Canadian people and institutions and government with interest free loans to further the strength of the country , Canadians and the sovereignty of the nation. Since Pierre Trudeau gave it to the IBS for it’s use,”
Well that should make it easy. The IBS exists to aid the Canadian people (including duals), to further the strength of the country and Canadians and the sovereignty of the nation. Since Pierre Trudeau gave the Bank of Canada to the IBS for its use, that should make it easy to fund the lawsuit against Pierre’s son.
I suspect @FuriousAC meant BIS, the Bank for International Settlements, and not IBS, the Isaac Brock Society.
An interesting commentary: http://thetyee.ca/Opinion/2015/04/17/Liberate-Bank-of-Canada/
@Tom:
You are right! Bank of International Settlements NOT IBS our own Isaac Brock Society!:
Control of the Bank of Canada was turned over to them in 1974.
From 1937 when it was created until 1974 when Pierre Trudeau turned it over to BIS the Bank of Canada worked well for the welfare of the country, to build infrastructure with interest free loans.
(Health Care. Hospitals, Schools, St. Lawrence Seaway, Trans Canada Highway, other provincial and municipal infrastructure projects.)
During that time, according to Galati, Canada prospered beyond her size and in comparison to other larger countries progress. Since 1974 the Bank of International Settlements , which is a consortium of privately held banks, takes the bank rate and adds interest to be loaned back to Canada these private interests have skimmed over 1.7 TRILLION dollars in interest alone off the backs of Canadians.
So, they took control of the Bank of Canada, adding interest where none was supposed to be and siphoned off the interest profit to themselves for their private use.
“When banking policies are turned over to private interest you have lost control of your own country and sovereignty ” Says Galati.
Banking decisions influence finances, businesses and all aspects of life.
These private banking interests in control of the Bank of Canada are not accountable to Canadians either parliament or the courts. They can do as they please and have hijacked the country’s financial life and are accountable to no one.
“YET, the law is still in place that the Bank of Canada IS a public bank and could be returned to it’s rightful use yet the government refuses to follow the law”
Galati gave North Dakota,( a state and not a country) China and Iceland as examples of those who now run their own central banks for public use.
In North Dakota, their bank has been in existence since 1905 and they have no debt.
China funds it’s own infrastructure with interest free loans as well.
In Iceland, they put the bankers in jail and forgave ALL loans of Icelander mortgages.
The Canadian deficit every year matches penny for penny the debt payable to private interests.
“The obstacle is with the government who refuses to follow the law and return the Bank to the country’s control. ”
“When we first set out on this case virtually no one knew the actual role the Bank of Canada plays in Canada . Since then, in four and a half years, more and more people have become aware. ”
“Young Trudeau says he wants to start a ‘infrastructure bank’ to fund badly needed upgrading throughout the country. My word to him is you already have one and it is called the Bank of Canada”-Rocco Galati
(Galati also stated that the Elder Trudeau regretted in later life actually turning the bank over. He said he had known little about economics at the time and had he known more he would never have turned it over. )
“We do not need a court to rule on this , we have the law. We are going to court to force the government to follow the law!!-
Mr. Galati also stated that this has international ramifications in that the trade agreements do the same thing, removing control of one’s country to a three judge panel bypassing sovereign courts and controlling decisions from afar making all peoples virtual slaves to a few private individuals.
He also said that the media blackout on this has been complete for over 4.5 years.
“Until last year when The Epic Times ran a front page story. Then the Toronto Star ran a piece then Amanda Lang had a 20 minute story on CBC. She was the only one to do an in depth story on it and now is no longer with the CBC. ”
He was told by members of the main stream press that they had orders to stay away from the story. The powers that be DO NOT want this story out because the people would demand return of control to the people of Canada.
This is costing taxpayers , depending on interest charged , amounts in excess of the budgets of several provinces and the entire military budget. Billions of dollars a year.
Mr. Galati quoted Thomas Jefferson:
Quotation: “If the American people ever allow private banks to control the issue of their currency, first by inflation, then by deflation, the banks and corporations that will grow up around them will deprive the people of all property until their children wake up homeless on the continent their Fathers conquered…. I believe that banking institutions are more dangerous to our liberties than standing armies…. The issuing power should be taken from the banks and restored to the people, to whom it properly belongs.”
Mr. Galati:
“North American grandchildren are now already out on the street homeless:
The state of the case:
Up against the elites of the elites, the International Bankers- he was asked how could it be won?
“It is so well grounded in law it is the reason there is a media blackout on it”
Four rounds of appeals, now heading to the Federal Court of Appeal.
@Calgary411 :
Great link. Fleshes out some aspects and is dated April of last year.
COMER and company have been working for a long time on this.
My impression is that this could be over tomorrow if the government just followed the law already in place. But they do not and will not.
In addition to the almost 2 Trillion dollars taken out of the Canadian economy since 1974 we have to PAY the government to fight the Canadian people on this.
As well as our own lawsuit and others they fight. They are not fighting on behalf the Canadian people they are supposed to be there to serve. They fight against us
Mr. Galati also stated in the interview that there are three things making slaves out of countrymen in Canada and the US: Student Loans. Car Loans and Mortgage Loans.
The effect of it all is that we are “slaves to elite entities whose only interest is their own private profit”

A lot of food for thought in the argument!
Parallels to our own lawsuit with the same harms detailed and one of the most satisfying legal thwaps to government officials ever read!
Folks, I just do not get it. There is so much valid, well-documented, principled, righteous anger, chest-thumping, foot-stomping rage on these pages. FATCA is undeniably an international outrage.
The IBS campaign is being spearheaded by dedicated, sincere and top-calibre people.
The IBS Homepage has had over 20,000,000 – that’s 20 m i l l i o n – views. If every one of those pageviews had generated donations of an additional 1/10 of a cent (penny? what do you call it in Canada?), the outstanding legal debt would have been paid off.
How much has the wisdom and generous support from this website been worth to your sanity and personal welfare already?
Can it really be that *every single one* of today’s readers really has something so *very* much more urgent and important on which to spend $25? And tomorrow too?
Come on, everybody, let’s get this thing done now!
Furious: Thank you for your posts. Although I’ve heard Mr. Galati’s name mentioned here I was not aware of the context until today. There’s been so much to read and become informed about that this has simply not been on my radar. I now see very clearly what a strong relationship it has to our own situation: the giveaway of our national sovereignty, the destruction of the rights of self-determination of our people, the possible hush-hush order to the media. It’s beyond shocking. It’s a 40-year cover-up of criminal proportions. I will be following this with deep interest from now on.
@FuriousAC @MuzzledNoMore @all
This 12 year old Canadian explained what need be done about the Bank of Canada back in 2012. Those who support the ADCS lawsuit should take heart in her closing quote from Margaret Mead:
“Never doubt that a small group of thoughtful, committed citizens can change the world; indeed, it’s the only thing that ever has.”
http://youtu.be/R3c-aN6Y7OU
—Still hoping that the remaining amount of our legal debt can be paid off soon.
@KingOfTheRoad,
“Can it really be that *every single one* of today’s readers really has something so *very* much more urgent and important on which to spend $25? And tomorrow too?”
Unfortunately, yes, some of us may be in that position.
To archive this letter to ADCS-ADSC from the Canadian Prime Minister I am posting this as a comment:
So now Justin, Scott, Jodi, Stephan and Kate “have taken the liberty of forwarding” letters about FATCA To Bill. Bill is silent.
Where is Bill? Where is OUR liberty?
I hope the courts will listen.
Thanks, Stephen.
My MP, Pam Goldsmith-Jones, Parliamentary Secretary to the above mentioned Minister of Foreign Affairs will be heating from me on this.
Hearing too…
lol – leave it?
@Bubblebustin:
That video is tremendous. In six minutes and out of the mouth of babes.
I want Canada to be Iceland. America too.
@All
Here is the interview with Galati Amanda Lang hosted on the CBC
https://www.youtube.com/watch?v=4ZuIKXXtQN0
Very informative.
@Calgary
Sure…both work 🙂
@Muzzled:
You are welcome.
I , too , was ignorant of this whole case until the last few months or so, maybe a bit longer.
Listening to Mr. Galati on C2C with Richard Syrett in Toronto brought it all back but piqued my interest in just why this needed to go to court and why it has taken 4.5 YEARS to even get this far when it is a law that is already in force and the only thing this suit seeks to do is force the government of the day to adhere to the LAW.
As for the IGA that so ties the hands and makes slaves and victims of another set of innocent victims offered up on the alter of bankster demands once again, the implementation of that in Canada also indicts our own government in complicity and betrayal of the very people they were elected to serve and protect. To adhere to the demands of criminals and miscreants who just happened to have control of a powerful government and even more powerful banking interests is betrayal of the highest order. Benedict Arnold would have been proud of it.
Will NEVER forget that snide , pompus and confident swivelling in his chair the Banker representative engaged in during the Senate Finance hearing.
EVERY time I have made a donation to ADCS I see that image!
http://www.comer.org
Reading the COMER website and listening to Mr. Galati enrages me even more since we have been compromised for over 40 years by an arrogant and ignorant PM who should have known better and only regretted it after retirement and too late to do the country any good.
Justin seems destined to follow in those ignorant footsteps since his words about forming a “infrastructure bank” indicates he does NOT know the Bank of Canada’s current legal and mandated prime responsibility.
I do not know which is worse, ignorance and arrogance of politicians or criminals in positions of power. I guess I have to go with the ignorance and arrogance of politicians. For without that, the criminals would never be able to GET those positions of power. Either in politics or banking.
I think the whole world should go Icelandic on ALL their asses!!
Until that time our lawsuit needs to get the engine running hot and fast and right now we need over $19,000 worth of gas.
Let’s GO!!
@TheMom
re “Can it really be that *every single one* of today’s readers really has something so *very* much more urgent and important on which to spend $25? And tomorrow too?
Unfortunately, yes, some of us may be in that position.”
Yes *of course* that is true for some (I’ve been there, I do get it). But this is not true for all, and not every day.
Come on, people… do the right thing.
As Edmund Burke wrote: “The only thing necessary for the triumph of evil is for good men to do nothing.”
The response is just a fob off letter. I’m sure government ministers hope the legal challenge will eventually peter out and they win.
Aren’t there any high profile Canadians with US taint to oppose FATCA or contribute?
