March 8, 2016 UPDATE: Legal fees paid — on to Federal Court for Charter trial contesting Canadian FATCA IGA legislation.
Canadians and International Supporters:
You came through once again: $594,970 for legal costs have now been donated and our outstanding legal bill is finally paid off.
Thanks especially to those who donated even though they never had any “spare” money to give, and despite this gave over and over and over again.
This last round of fundraising also shows that our Canadian lawsuit remains dependent on the kindness of our International Friends: There would be no lawsuit without their financial help.
Know that a very generous donation (today) from a supporter in the United States made it possible to pay off the remaining legal debt. Also please appreciate that there would be no lawsuit without the help of the Isaac Brock Society which has kindly let us use its website to solicit funds.
Our next step is the Constitutional-Charter trial in Federal Court.
For this we need more Canadian Witnesses, and my next post will be devoted only to a request for Witnesses willing to go public, like our Plaintiffs Ginny and Gwen.
For the future: I want a win in Federal Court — and I want the new Liberal Government not to appeal that win.
Thank you all for your support,
Stephen Kish,
for the Directors,
Alliance for the Defence of Canadian Sovereignty
@Stephen, I don’t think Alex or Furious or anyone else is trying to suggest we ditch the lawsuit in favour of trying to convince US-free Canadians that they too are being hurt by the FATCA/CBT wealth extraction tool, but rather that we should be strategic with regard to how we try to educate fellow Canadians, particularly since we don’t have a crystal ball and don’t know how the lawsuit will play out. When we do eventually get to trial, there will be more media attention that we will want to take advantage of and so a rethink of how we portray the issues is food for thought.
If I ever have a chance to speak to media again, maybe I will say, “The Americans are coming. The Americans are coming! Run for your lives!”
@All:
To clarify:
I mean simply by my posts that litigation should proceed apace. And Do Not Spare The Horses!
I hope that clears up any misconceptions regarding my posts and posting Alex’s excellent suggestions.
I have contributed , will continue to contribute .to the cost and to the effort in any way I can do so.
The Canadian who was harmed in this whole disgusting affair cannot come forward to testify, though he would most certainly were he able. He is not. He is dead.
There is nothing on earth that will stop many of us from supporting proceeding with litigation and we are all aware of the time and money it will take.
Many of us will not live to see the day we succeed in having our sovereignty restored but it does not mean we do not support it wholeheartedly and with every resource at our disposal.
Our ADCS team is second to none! (as I am sure the Bopp team are stellar. )
However, there are formidable forces arrayed against us , big banks, politicians, special interests, including the courts.
The hurdles must be climbed and overcome ( as the funding hurdle is slowly being whittled down.)
Would that even one of us had the wherewithal to pay the entire bill right this minute.
As it is, we carry on as best we can. But we DO NOT QUIT!
Our team has heard the words said before that they are thanked and appreciated but I do not believe they realize to what extent that is meant.
There are many of us who would not have been able to carry on without this effort put forth by brave and intelligent souls willing to fight this fight and attain what has become for many an impossible dream.
For myself, personally, I do not feel that way.
I say FIGHT! And the higher the mountain to climb only means the better equipped we must be to attain the goal.
I am sure our team and our legal team feel unappreciated many times a day but I can only say that so many of us have such a grateful heart because we cannot do what you are doing on our behalf. There is a special place in Heaven for you all !
We need to pay off the lawyer… we need to move this into court… the US can decide to change the game… we want to know every darn thing u have… Canada says now they will not help in the collection… the US has the means to just help themselves to what u have since they have all the info from your banks/CRA… what will u do if the US helps themselves… right or wrong… who will u turn to for help? Canada… good luck with that… US… again… lots of luck there.
Even if its a small amount given… its better then nothing… Faster we get rid of this number… faster we will get our day in court to stop this. We have no choice since no one will listen or help us… no gov’t person… media… no one… we can only help ourselves… If we don’t go to court because we couldn’t raise this last of the money… we have no one to blame but ourselves… The gov’t will win by default…
Marco Rubio, a U.S. Presidential candidate, is on record:

@Tom Alciere
We also now have the Treasury Department on record saying, ” “The effectiveness of these measures depends significantly, however, on the United States’ ability to reciprocate.” That to me is a first, and something we can take to our MP’s to quash the IGA at the first opportunity. I’d like to see the 20 page document from Treasury that the article refers to.
“A chief concern of critics has been Venezuela, whose president, Hugo Chavez, is a sworn enemy of the United States. A Treasury statement made clear that the U.S. “does not, and has no plans to, exchange information” with the South American country.”
I suppose those traitor Americans who live in Venezuela deserve everything they get , including extortion and blackmail then.
Take care WhiteKat.
“Thanks to today’s donors from Germany, Switzerland, Australia (2), Japan, England, United States, Canada, Eurotwig (twice) and Ann#1 — and the two $25 daily donors from UK and U.S.”
I just wanted to put this in the comments because tomorrow it will be replaced by a new update. As much as I love to see the amount due dwindle I love days like this when there is a long list of international donors. It’s “the bee’s knees” or to anyone too young to know this saying, it’s simply “excellent”.
*The hypocrisy* reminder with another article from Bloomberg that we may or may not have (forwarded to me in email):
“However this link may be of interest to Brockers: http://vz.lt/premium/bloomberg/2016/01/27/the-new-switzerland-rothschild-promotes-us-as-world-tax-haven#ixzz3zZbQFyYX” (Bloomberg News – The New Switzerland: Rothschild Promotes U.S. as World Tax Haven).
Sending in another $100.00 in tonight’s mail. Again, Thank you Mr. Kish and to everyone who is working so hard to defend the sovereignty of ALL Canadians. And lets hope our Prime Minister will step up to the plate to support and recognize us All Canadians as True Canadians.
@Canadian Ginny–your words resonated in my head like a bell— in Daniel 12:2 “Many of those who sleep in the dust of the ground will awake, these to everlasting life, but the others to disgrace and everlasting contempt”——- just to say I took this as ONLY a personal metaphor for myself, that I need to do more for IBS or my own conscience will hound me.
I am in the process of rebudgeting February to try to see if I can project to save up another 500 CAD so to allow me to donate this sum in next 24-48 hours or so…. I couldn’t bear to see the lawsuit fail after 96.1% raised. ……..
I close with a [paraphrased] quote from Numbers 10:1-7— “The LORD spoke—- saying, “Make yourself two trumpets of silver, of hammered work you shall make them; and you shall use them for summoning the congregation and for having the camps set out.””. (no I am not a Trump-ette !!! I dont have the blue book anymore so can’t vote ! ) . the CAD 22971 figure is my call to arms, my trumpet of silver, that at time of writing I hope to see go down dramatically in next few days.
I pray that the Big Kahuna upstairs blesses all of the work since late 2011; y’all are truly inspirational.
With regard to the outstanding legal bill, I have a suggestion, which is a long shot at best, and I apologize if this has already been tried. It has often been said that no “deep pocketed” donor has stepped forward to help with the lawsuit.
I am aware of two men in the Canadian oil & gas industry who were definitely (Mr. Richard George) or likely (Mr. Anthony Marino) born in the US. I have seen both men interviewed on TV and they both speak with American accents.
Mr. George was born in Colorado (easy to find on the internet) and was the CEO of Suncor for years. He is currently Chairman of the Board of PennWest Petroleum:
Head Office
Suite 200, Penn West Plaza

“Mr. Rick George, O.C., served as a director and the President and Chief Executive Officer of Suncor from 1991 to 2012. During his tenure at Suncor, Mr. George showed exceptionally strong leadership in transforming the company from an oil sands pioneer into Canada’s largest energy company. Mr. George is currently a director of the Royal Bank of Canada and Anadarko Petroleum Corporation and a partner of Novo Investment Group (an investment management company). Mr. George holds a Bachelor of Science degree in engineering from Colorado State University, a law degree from the University of Houston Law School and is a graduate of the Harvard Business School Program for Management Development. Mr. George is an Officer of the Order of Canada.”
Mr. Marino is the new CEO of Vermilion Energy:
Head Office Vermilion Energy Inc.

Calgary, Alberta T2P 0R3
Phone 1-403-269-4884
Fax 1-403-476-8100.
“Mr. Marino is an accomplished senior executive with a proven track record of high performance during his 32-year career in the energy industry. Mr. Marino is President & Chief Operating Officer of Vermilion and joined Vermilion in June, 2012 as Executive Vice President & Chief Operating Officer. Prior to this, Mr. Marino held the position of President and Chief Executive Officer of Baytex Energy Corporation, after initially serving as Baytex’s Chief Operating Officer. Prior to joining Baytex, Mr. Marino held the role of President and Chief Executive Officer of Dominion Exploration Canada Ltd. Earlier in his career, Mr. Marino held a variety of technical and management positions with AEC Oil and Gas (USA) Inc., Santa Fe Snyder Corp. and Atlantic Richfield Company. Mr. Marino brings strong experience in production operations and the development of oil and gas resource plays to Vermilion. In addition to his operating experience, Mr. Marino also has an extensive background in business development and oil and gas marketing.
Mr. Marino has a Bachelor of Science degree with Highest Distinction in Petroleum Engineering from the University of Kansas and a Master of Business Administration degree from California State University at Bakersfield. “
It appears that both men have lived in Canada for years after coming from the US.
Over the last year and a half I have tried (as a stranger) contacting people by phone or email to support the ADCS, with little apparent success. Direct face to face contact may have a better chance. Would anyone in the Calgary area be willing to get together and make an appointment to meet with either or both of these two men to make an appeal to their sense of justice and violation of Charter rights? A small group of people would likely be more effective than just one person.
As Mr. George is on the Board of Directors of the Royal Bank he is probably not on our side, but as we all know, life is full of unexpected twists and turns. Maybe one of them will be sympathetic – not likely I know, but what is there to lose, if a few are willing and able to try?
Mr. A,
Thanks for your suggestion. I mention in a comment in another thread: http://isaacbrocksociety.ca/2016/02/06/perhaps-after-reading-this-you-could-suggest-a-title-for-this-post/comment-page-10/#comment-7192332.
Is it even worth staying compliant …….at 350.00 accountant bill every damn year im poor broke lucky if i have 1000 bucks in the bank thats including my savings after pay day ,, but i pay the stupid fee every damn year fed up with it as its pointless do you still continue ?
reading old post on here about Canada wont collect fines or debt for the US ?
i am a Canadian citizen
I / we hear you, Bruno. Even though $350 is a damn good yearly price for being able to stay US tax compliant, it is so unaffordable for many — your question is correct. And, yes, you are a Canadian citizen so hopefully the government will honour their claim made through the former (and now deceased) Finance Minister James Flaherty (an example in the content in this reply many of us received from Mr. Flaherty): https://www.cma.ca/Assets/assets-library/document/en/advocacy/FinanceMinister-reply-Jan2012.pdf.
@calgary411
US has the info needed… they could just help themselves with the help of the banks… been done before… I think it was TD that did it… they were sued in Canada… got the funds back… this can take awhile & u must have the means to sue… if u are relying for help from the gov’t… forget it…
We have gotten together world wide to stop it… but we are having a hard time raising the rest of the funds to head to court… Looks like both gov’ts have won… only way to make them pay heed is in court…
Realize everyone world wide is suspect of being a US person… u will have to prove u are not… how do u know the bank will not suspect u of being a US person & just send your info to the US… Good luck in clearing that one up… The US is getting all this for FREE… we will all have to bear the cost of it… money that is meant for our country is been used for another country’s gain… Do u think the banks & govts in our country work for free… where do u think they are getting all this money from…. Some say… ohh… we will get info from the US… not really… real money is already hidden away in the US… even if they catch a few… its a small penalty compared to what the US is doing…
A few dollars is better then no money donated… the US will have a database created from FREE info… paid by everyone worldwide… The US is demanding this of all gov’ts… they should PAY for it… not only are they getting FREE info… all fines collected by the US is for the US only… People world wide are now supporting the US in their quest of unfair policies… paid out of our pockets for the GAIN of the US only…
Today my employer was Fatca’d. It came in the form of a letter from the TD. The TD claimed that they were required by the CRA to ask if your business or trust accounts were owned by a US person for tax purposes.We should be getting another (6) letters. It took them long enough! Failure to respond in a timely manner would result in your information being turned over to the IRS.
Ann,
I do not know your employer’s situation, but if he/she is interested in being a Witness in our lawsuit — or if anyone else is in the same situation as your employer, please let me know.
stephen.kish.chair@adcs-adsc.ca
@Stephen He is A Canadian with Scottish roots. He’ll be fine.
Bruno. Pay no attention to US foreign person. The US has no way nor desire to go after a Canadian living in Canada with no US assets.
@crystalLondon
Not sure which words you referred to but glad they resonated.
@Duke of Devon
Why in heavens name would you suggest someone who’s US tax compliant suddenly stop filing? What Bruno should do is renounce if they want to stop filing – he/she’s in the perfect position to do that!
@Bubbles
Perhaps because what DOD is saying is with Bruno’s net value why waste any more money? Can’t get money out of a stone.
@Ann#1
That gave me a chill. Not surprised it was TD though. Agree with Stephen, would make a good witness.
BB I said no such thing. Please don’t put words in my mouth.
Bruno asked if Canada would help the US collect fines or debts in Canada.
US foreign person suggested they would- ‘they could just help themselves with the help of the banks’
I merely said that this was nonsense. The US has no way to collect fines or tax debts in Canada.
