March 8, 2016 UPDATE: Legal fees paid — on to Federal Court for Charter trial contesting Canadian FATCA IGA legislation.
Canadians and International Supporters:
You came through once again: $594,970 for legal costs have now been donated and our outstanding legal bill is finally paid off.
Thanks especially to those who donated even though they never had any “spare” money to give, and despite this gave over and over and over again.
This last round of fundraising also shows that our Canadian lawsuit remains dependent on the kindness of our International Friends: There would be no lawsuit without their financial help.
Know that a very generous donation (today) from a supporter in the United States made it possible to pay off the remaining legal debt. Also please appreciate that there would be no lawsuit without the help of the Isaac Brock Society which has kindly let us use its website to solicit funds.
Our next step is the Constitutional-Charter trial in Federal Court.
For this we need more Canadian Witnesses, and my next post will be devoted only to a request for Witnesses willing to go public, like our Plaintiffs Ginny and Gwen.
For the future: I want a win in Federal Court — and I want the new Liberal Government not to appeal that win.

Who said the status update request from the court was money related? I’m no lawyer, but logic would dictate it would be process related…like have we received the required docs the feds held up.

That seems logical to me. Anyway, I’m sure Joseph Arvay understands that there are no deep pockets on our side and a bottomless pocket on the government’s side.
Didn’t the defendants’ team hand over 100,000 pages of documents? Perhaps the status report is to find out how many pages the plaintiffs’ team has read so far.
I have just read the above comments concerning the status update from the court. This is in no way related to whether or not our lawyer has received his full funding. The court is not privy to any such arrangements between solicitors and clients.
This is a unique case and situation ( grassroots funding) in that we are publicly transparent about what our legal funding commitments are because you as donors are our FUNDERS.
Basically this is pro forma, a tickler reminder system if you will whereby the court sends out notices to plaintiffs to ascertain what their intentions are, and since in our case, this is case managed, it can also be seen as a request to both sides as to how the court can assist in moving this along.
This does not obviate our responsibility to pay our legal bill, which is what Dr. Kish emphasizes each day.
It has also been mention that a solicitor is entitled to have the Court remove him or her from solicitor of record due to one or a number of factors, retainer being one of them.
This is not our case and I emphasize this. Yes, our lawyers have been patient about receiving their ongoing retainers- which speaks to their integrity in my opinion- but we all know we need to and will get this done as soon as we can.
It is then and with the call for witnesses to be vetted and completed that we will be in the position to advance of case.
You give me the confidence to believe we can and will get this done soon. I have said this before but it bears repeating. It is personally difficult for me to ask people to donate their hard earned dollars or any other currency. I cannot imagine how difficult this has been for Stephen Kish to do this daily. We owe him thanks for his perseverance. I much prefer to be a plaintiff!

Yes, that was helpful. Thank you. We didn’t get 95% of the way to the mark to turn around and call it quits. The fee to the legal team must be paid 100%.
Personal note:
My five year old grand daughter asked me today what I would like for my special birthday. I am sure I am ancient to her. My children have discussed with their children what I am up to. That’s just normal conversation in our family.
Anyway, I asked her if she would be willing to donate one month of her allowance to Nana’s cause. I equated it to her in a way I thought she could understand to those who have donated their CPP or OAP, in that some have often supported us with their whole monthly allowance.
So there’s a $10 donation winging its way to our fund. Thanks to my sweetie V.

Thank you, Bubblebustin, I will be sure to tell her she has inspired you and hopefully others. She’s quite the little spitfire for her age. Her older brothers declined birthday presents one year and asked that all of us instead donate to a food bank where their parents take them to be volunteers setting tables, helping out as they can. It’s never too young to start, imo, and I am pleased the family tradition continues.
Start ’em young as my father used to say. I often hear people say well what can I really do about world poverty etc.
Beginning in your own community is never a bad option. One can always expand from there.
Folks. I am confident that ADCS’s Attorneys are eminently reasonable people and I do not think that they will surrender our case because we are late with $30,000. I am sure that they know that the contributions are coming in and will in due course pay off these arrears relating to the Summary Trial. The Full Trial at this level is, I believe, already paid in full at $500,000. The $30,000 is important but it is not the end of the world in my view should it be delayed a short while. Of course we must all continue doing our very best to raise these funds ….AND funds for a further appeal !
We will make it. We are the world’s only hope.

As this points out and as we well know, those challenges go beyond financial and include “government delay, document dumping, and excessive procedural manoeuvring during constitutional litigation.”
That is certainly our experience. And a reflection of why we need to get this lawsuit funded.
Glad to hear CBC, our national public funded broadcaster is picking up the pace on our cause. It’s perhaps an indication of their shackles being removed from what the previous government imposed.

If you are in Windsor and are concerned about world poverty you can start in your own community. But eventually that will mean expanding just a little across the river to Detroit where I can say there exists poverty no Brockers could possibly understand. Eventually your granddaughter will understand even if you don’t.

Could this be a new way to legally transfer FATCA data. For example, could Deutsche Bank legally transfer collected FATCA data in Germany to their US subsidiary as a company to company transfer?
The other two ways being from local bank to its local tax authority and then the IRS, the other being a direct from the bank to the IRS transfer.
It needs examining.

Stephen, I tried twice. It comes up with a security warning in red and wants to redirect me. At any rate, I just need the address because while my husband doesn’t have a problem with me sending a donation, he would like it to be cash.

Don’t know what your issues are due to but there may be global computer issues going on …..I have found my PC behaving very badly indeed in Jamaica today … I suspect downloads of software updates from Microsoft. Even now whilst the PC seems to have resumed working, when I print anything only a blank sheet is coming out of my printer. Weird.
My computer is very slow this evening as well. Perhaps this?
