March 8, 2016 UPDATE: Legal fees paid — on to Federal Court for Charter trial contesting Canadian FATCA IGA legislation.
Canadians and International Supporters:
You came through once again: $594,970 for legal costs have now been donated and our outstanding legal bill is finally paid off.
Thanks especially to those who donated even though they never had any “spare” money to give, and despite this gave over and over and over again.
This last round of fundraising also shows that our Canadian lawsuit remains dependent on the kindness of our International Friends: There would be no lawsuit without their financial help.
Know that a very generous donation (today) from a supporter in the United States made it possible to pay off the remaining legal debt. Also please appreciate that there would be no lawsuit without the help of the Isaac Brock Society which has kindly let us use its website to solicit funds.
Our next step is the Constitutional-Charter trial in Federal Court.
For this we need more Canadian Witnesses, and my next post will be devoted only to a request for Witnesses willing to go public, like our Plaintiffs Ginny and Gwen.
For the future: I want a win in Federal Court — and I want the new Liberal Government not to appeal that win.
Thank you all for your support,
Stephen Kish,

I just listened to the cbc interview and I too am pissed at lisa raitt.
she makes it seem like there was a gun at their head and they only choice they had was to comply with amerika. what ever happened to “just say no”?
at least it sounds like the ndp are still on our side and will be keeping the pressure up on the liberals to come clean about what they know
time will tell……………………
Yes, the FATCA IGA will be hard to undo. Too bad the Cons have made so much work for everyone else as a result of their capitulation to the Canadian bank’s fear. As Trish has pointed out, true leadership was lacking when all of this went down.
Yes it will be difficult, proving once again that the path of least resistance is twice as long.
I know this is likely stupid and naive but I still hope that the lack of response from the liberals is because they are seriously trying to work this out. This has to happen behind the scenes however frustrating that is. We must keep the pressure up and get this law suit fully funded. Despair alone is not going to get it done.
Why didn’t Lisa Rait come out and say that Canada had no choice but to sacrifice Canadians to the US as a result of the threat of sanctions? Why not tell it like it is instead of worming out of the truth? Maybe, the buck stops with our lawsuit as this lawsuit is a grass roots lawsuit about putting basic human rights first. Canada has changed, it is no longer a country envied by other countries. We now must fight for our rights and the government is a group of liars and snakes.
Can someone tell me which program at CBC this interview falls under?
@Ann#1
Here’s the podcast:

@NativeCanadian
We’ve actually got them in a trap and I think they know it. Their actions are well documented. It’s going to come down to how convincing they are about having “no choice”. The million dollar question is whether the Liberals are going to use the same lame excuse.
Do you think the court and the Canadian public are going to buy it? All depends on if and how hard the Liberals try to sell the notion of the US having jurisdiction over those they deem to be its property in Canada, like the last government did.
@ Bubblebustin… Do you know which program on CBC was responsible for airing the program? I would like to write them.

Would you become a US citizen and lose your financial freedom just to be able to vote against Donald Trump?
That’s what some foolhardy Homelanders are trying to organise.
Wow,
… and some time later they may realize what else they have done (probably not having made an iota of difference in the outcome of the US election).
Lisa Raitt fails to mention (of course) that they did have an option. They could have told the US that any attempt to extort information from Canadian financial institutions will have serious negative consequences for relations, and that if pushed, reciprocal taxes would apply to US corporations in Canada. Instead, they admit they capitulated to the US bully.
I’ve added my comments over at “All In A Day.” I would encourage other folks to do so in order to keep the CBC anti-FATCA ball rolling.
@ Ann#1 and others
Comments can be made at CBC but remember moderation holds them back for many hours.

The longer the misconceptions surrounding FATCA are allowed to exist, the deeper they become embedded and the harder it becomes to dispel them. The charter challenge will blast away these misconceptions so that’s why we must get the trial funded as soon as possible.
@Embee Thanks, but I am going to write a letter. I am afraid to comment until I have the CLN.
@ Ann#1
A letter is even better.
I just heard Stephan Dion on cbc Announcing that the Liberals are preparing to lift sanctions against Iran. Yet on FATCA, Dion sent my letter to Morneau. Morneau continues to be silent–just like the rest of the Fibbing Libs.
@ Blaze
A BBism for that would be “Pass the Buck to the Bill.” 😉
I just called the Parliament office in Ottawa to find out the length of the deafening silence and what the number 45 means (business or calendar days).
I was told that the Liberal Government-in-hiding is supposed to respond (and I assume that they will) to the many NDP FATCA compliance questions 45 days from January 21.
So by March 7 (a long time from now), Prime Minister Justin Trudeau should come out of hiding.
We still however have the CBC pushing for an interview with the Liberal Government but with no success.
—Thinking that a phone call might work better than an email I called the local Toronto office for my Liberal MP James Maloney, and asked the secretary to pass on a request to Mr. Maloney in Ottawa that he help find a Liberal Government person willing to speak to the CBC on our FATCA lawsuit (I also provided the CBC contact information). Maybe others could do the same.
@Embee that buck has been spinning since it stopped with Harry Truman.
@Stephen I will call my MP again, but so far Kate is refusing to meet or discuss FATCA with me until she knows what Bill will do. It seems like he is dropping the buck that everyone else passed to him.
I like Canoe’s idea about an image or graphic to illustrate these shenanigans. Anyone available? I can think of someone who would be perfect, but I don’t want to volunteer her.
@Cheryl I also would like to believe the Libs are trying to work it out. But I thought the same about Flagerty’s silence after he initially came out so strongly against FATCA. Look how that ended. So, bottom line is we need to get Ginny and Gwen’s lawsuit funded.
I agree. Hope springs eternal.
Similar logic also holds in that Canadian citizens born in the USA should register for selective service and Canada should assist
I think if you put it in those terms and remove tax then folks can understand better
They should not be evading selective service
@Blaze I just tweeted my former Liberal MP Marc Garneau letting him know the politely written letter I sent him back on December 3rd has thus far gone unanswered. I am a Liberal Party member and donor.
We are not amused.
Retweets of my tweet would be appreciated.
Thx!
BC Doc
P.S. Happy birthday plus a day!!!!
@BCDoc & others The best belated birthday gift would be an announcement by the Liberals to amend the FATCA Enabling Act. The second best gift would be to get the lawsuit funde
Instead of donating to the Fibbing Libs, please donate to ADCS. Unfortunately, those donations do not qualify for the huge income tax credit that political donations do.
@George I won’t give them ideas. It would not surprise me at this stage if the U.S. tried to enforce selective service beyond their borders.
