March 8, 2016 UPDATE: Legal fees paid — on to Federal Court for Charter trial contesting Canadian FATCA IGA legislation.
Canadians and International Supporters:
You came through once again: $594,970 for legal costs have now been donated and our outstanding legal bill is finally paid off.
Thanks especially to those who donated even though they never had any “spare” money to give, and despite this gave over and over and over again.
This last round of fundraising also shows that our Canadian lawsuit remains dependent on the kindness of our International Friends: There would be no lawsuit without their financial help.
Know that a very generous donation (today) from a supporter in the United States made it possible to pay off the remaining legal debt. Also please appreciate that there would be no lawsuit without the help of the Isaac Brock Society which has kindly let us use its website to solicit funds.
Our next step is the Constitutional-Charter trial in Federal Court.
For this we need more Canadian Witnesses, and my next post will be devoted only to a request for Witnesses willing to go public, like our Plaintiffs Ginny and Gwen.
For the future: I want a win in Federal Court — and I want the new Liberal Government not to appeal that win.
Thank you all for your support,
Stephen Kish,
for the Directors,
Alliance for the Defence of Canadian Sovereignty
Thanks, Pacifica, for all you do here and elsewhere, saying…
Happy new year everyone!! A couple of items that I am working on. First, I am wondering if the Obama proposal for accidental Americans has gone through. The second thing I am working on is to be a part of this fight and to make it known across Canada. I am currently in talks with a printer here locally to make the first run of Canadian charter Toilet paper. We are working on creating the first of its kind in Canada. You can wipe your posterior with the Charter. If Canada chooses to try to bias the judge with the ” USA made us do it or else” Card, then our charter is ass wipe. Once I see how government handles this, I will go ahed with the Charter toilet paper. I will deliver these new wipes to all newcomers to Canada and will try to send them to any and all meeting places that immigrants might go to. The word MUST get out to ALL Canadians and we ALL have to enter the fight!
The proposal for accidentals got lost in the ‘historic compromise’ to fund the US for a few more days and the dust of congress critters rushing home for the holidays
@Native Canadian………..Do NOT wait on the toilet paper…its a brilliant idea!!!
Rolls need to be sent to the media, and MPs…
It will cause them to ask questions which will need to be answered.
I searched GOFUNDME.COM and found nothing under FATCA or ADCS. Why isn’t ADCS soliciting through GOFUNDME.COM ?
Tom,
Here is the explanation in a prior comment – The funding of the @ADCSovereignty #FATCA lawsuit explained.
http://www.cbsnews.com/news/meet-the-man-behind-the-rose-bowl-skywriting-bash-of-donald-trump/
Not sure what it would cost but telling America to FATCA OFF via sky writing?
@Don, I personally try to be non-judgmental of foreigners who live in their foreign nation. They are what they are, but I do try to figure them out.
The party that did the sky writing think Trump is a “racist” but the reality is they are also racist and extremely so, they are nationalistic racists.
The first part of the sky writing was “America is Great.” The very essence of that comment is nationalistic racism. It implies/states that USA is superior to all other nations.
Do you ever think we will see skywriting that states;
Canada is Great.
European Union is Great.
Republic of Ireland is Great.
The reality IMO is that America is simply a nice place equal in stature to many other nice places, nothing more and nothing less.
Native Canadian: I *love* the toilet paper idea and I agree with George with one small modification. Wait until Stephen confirms that the Canadian government has released its documents to our lawyers. That is expected in just a few days. Once that happens we’ll know for sure what the status of our Charter is in the government’s eyes. No need to wait and wonder any longer.
George: In addition to all the wise things you say here, thank you for your steadfast support!
@Muzzled, yes that document dump might be an interesting treasure trove. Kind of like a box of Whitmans Chocolates without the guide. 😉 You do not know what is inside….
In the following quote, Ohio Gov. John Kasich, a Republican running for President, is actually speaking of leading the war against the islamic State, and the quote would be way out of context if I did not say so. However, the quote by itself does reflect a general attitude about a duty to lead the world.
http://time.com/4119069/isis-john-kasich/
“For too long we have shown an unwillingness to lead. One administration official said we should lead from behind. This is unacceptable. If America does not lead, we will leave the world a much more dangerous place. “
Hmm. America’s “leadership” in the tax arena has made the world a much more dangerous place for her expats. Not sure I’m ready for much more American “leadership”.
@Muzzled…..someone recently at IBS had a link to a fascinating paper on citizenship. Citizenship by the soil has its links to feudalism whereby those born to the soil are the property of the lord or king.
I believe US slavery laws were the same.
Previously I took comments pertaining to “being property” with a grain of salt but now I can see that it is ingrained in the US psyche.
Seeing the aerial “billboard” article on Trump helps cement that because in addition to impugning Trump it said “America is Great.” You know the mantra U-S-A..U-S-A…….
I think most Brockers are content to say “America is a Nice Place, Ireland is a Nice Place, Canada is a Nice Place……..” but great?
Tom Alciere,

Seems to me John Kasich should have referred to American leadership by hegemony (to relate to other terms in our daily lives, bullying). Is that the only way or should people of the world try something that makes more sense for a change? https://en.wikipedia.org/wiki/Hegemony
Norman Diamond brought forth an old post that is interesting: http://isaacbrocksociety.ca/2013/03/22/letting-go-and-moving-on-how-to-deal-with-the-anger/comment-page-3/#comment-7028608
Back to the subject of this thread, is this litigation to be thwarted by the same fear, that same type of American leadership? Our governments know the power of fear as we see their cowardice for they, like us, are fearful of US sanctions to their economies — i.e., *CONGRESS HAS SPOKEN*.
Seems to me that we will lose our great opportunity if we fail to come forward as a united force now — as witnesses and donors for the ADCS-ADSC litigation. How I would hate to see this opportunity squandered as I believe it will be extremely hard to come together again some time in the far future if we will wait to see the actual bloodshed of real harm of CBT to people like us who are *US-deemed US Persons Abroad*.
Burned in my mind is what John Richardson so often reminds us…
This opportunity just may not pass our way again.
I find it interesting that Roy Berg emphases that IRS will use ‘collection agencies’ to come after ‘innocents abroad’ in Canada and around the world, but does not object to what is written right in the IGA that ‘third parties’ may and will be employed to spy on , report and ‘aid’ both banks and CRA in ferreting out possible ‘US Persons as deemed by IRS’ and reporting that information to the IRS via the CRA.
WITHOUT benefit of Probable Cause or getting a Warrant based on a case presented to a judge that there IS probable cause. Just too inconvenient and time consuming! ( as testified to by Canadian law enforcement, when asked in Senate Finance committee about getting a warrant, ‘ well, it is terribly inconvenient and we would prefer not to have to do it, but it IS the law’! )
THAT law overridden by the Canadian IGA just as roughshod as privacy laws.
‘Collection agencies’ are utilized to collect ‘taxes’ by the IRS? They could save themselves a few billion dollars by starting with their own staff who ‘collectively’ owe over 35 billion dollars in unpaid taxes.
When 50% of the population of the US is on welfare and ‘collecting’ a cheque from the federal government would it not be in THEIR best interests to ‘collect’ those unpaid ‘taxes’ to further their ability to ‘collect’ a welfare cheque!
That should keep them in business in the US rather than sending an invading force of ‘collection agencies’ to Canada where there are no ‘taxes’ to collect. Only fines , penalties and any other abusive bludgeon they can think of to hammer innocents while engaging our own government in this criminality.
Oh, but all those entities pouring across the southern US border, flying in on UPS planes and loaded on buses to be dispersed nefariously across the country, given money, food, shelter all costs money that must be ‘collected’ from somewhere! Not to mention that 1.8 Trillion dollars just passed by Congress needs to find the money from somewhere.
They cannot handle their own budgets responsibly so seek the world over for every jot, tittle and dime to squeeze out of those least able to resist.
What IS to be said for the likes of the Roy Bergs of this world who sit with government lawyers figuring ways to thwart justice for those who have been most harmed? For that matter, what is to be said for ‘government lawyers ‘ who are there for the express purpose of thwarting justice?
When we consider the events of just the last few weeks, wherein our Canadian government , newly elected and having taken the oath of office, now declare that every campaign promise they made will likely NOT be kept, it brings our responsibilities into sharp focus.
CARP is most upset at the betrayal, yet there it is. No explanation nor any time line as to when or if that campaign promise will ever be met regarding CPP payments.
So, too, the proclamations of solidarity for the lawsuit, that Bill C-31 would be revisited when they were in opposition and while campaigning have now disappeared.
With the government lawyers, now instructed by a Liberal government rather than a Conservative one, , still dragging their feet on producing documents.
As many have said, ‘Justice delayed is justice denied’. ( NOT to mention the ruling by the judge!)
Now THAT was a blow and now doubt about it. You could see the morale around here plumment to the floor.
There has been a lot of grumbling about the money and constant pleas for donations, and it is understandable considering the disappointment of the ruling, but it IS the necessity of the day!
( Consider how our leaders and plaintiffs must feel about having to plea constantly for donations, they are human , too, and involved daily in the struggle to free us all)
Would you have any one of them run out on to the field of battle as young Isaac Brock did, giving his life at 29 for the future of his country? For the Sovereignty of Canada?
No one would ask them to lay down their lives, yet they do sacrifice daily on behalf of the DEFENSE of CANADIAN SOVEREIGNTY.
Personally , for me, I do not care HOW many lawsuits are launched, I am in favour of them all!
It is mandatory this be challenged wherever it is met.
As Calgary411 says, ‘ if we do not do this now, who says there will be a chance later, or ever again’ to fight for our rights and freedoms.
I am sure most everyone here are of limited funds but we do buy things of necessity daily, weekly, monthly. Many of us are on pensions and we see those pensions eroding , yet we find sums, however small to ensure our lives of the necessities.
To me, funding our lawsuit is one of those necessities I cannot live without for I cannot live with what our future will be without winning our freedom and sovereignty back!
.
We are being jackbooted on every front. From the implementation of the Canadian IGA, to the G20 tax regime , to the TPP, the devils are truly in the details. If ANY one of these comes to fruition as planned our freedom, liberty and sovereignty are gone , and gone forever.
In the US, where the people are just as frustrated as we are , with the lawlessness, criminality and true obstruction of justice and WORSE against the people, a man like Donald Trump arises , and for good or ill, finds his words and plans have great resonance in the population politic. And for good reason. They KNOW they are under assault from every front by their own government. They have tried changing Congress, first in 2010 and then in 2014 only to realize their overwhelming success at voting in a party they thought had their and America’s best interests did NOT and once elected proceeded to betray every oath of office they took. They are bombarded from every side, and daily individual freedom erodes. They are under assault as never before and they know it.
Trouble is, WE do not know it. Not yet. Canada has not awakened YET.
The assault here is very real and is fought by only ONE lawsuit that has a chance of restoring our individual freedom and ensuring our sovereignty. And the ONLY thing we have that we can openly both support and fund.
As Stephen Kish explained, ADCS IS a GoFundMe entity.
WE are the Vanguard, the Tip of the Spear and it is past time to sharpen it with the money needed to push forward.
Once our lawsuit is won ( from our hearts to God’s Ear!) it sets legal precedent for the fights to come regarding TPP and OECD Tax Regime. This is crucial and fundamental.
Time to stop fooling around and get our shoulders to the wheel. It really IS up to us.
As Roy Berg says below and in the post above:
[Canada’s tax compliance attorney supremo, Mr. Roy Berg of Moodys Gartner, a U.S. person himself and never one to de-emphasize the harm, has a way with words and tells the “Globe and Mail”: “The new [U.S.] legislation will also see “inactive” tax debts that the U.S. Internal Revenue Service has been unable to collect handed over to private debt-collection agencies, he added: “So, it’s not the IRS that may be coming after you, it’s ‘Dog the Tax Bounty Hunter.’”
Unfortunately, I can see this happening. Roy Berg is a cross border tax condor but he may be right about “Dog the Tax Bounty Hunter” coming after “inactive tax debts”. Recently, I’ve met a couple of unfortunate “US Persons” who have lived in Canada for many years as permanent residents but never became Canadian citizens. These “head in the sand types” would be prime targets for IRS bounty hunters. Let’s hope they wake up in time and at least contribute to the lawsuit.
In university I was talk that for any tax to be successful is must be easy to collect.
What bird brain in the US Congress honestly believes trying to collect money from ex-pats who will fight tooth and nail via there local legal system is going to raise a lot of money for the US?
The US Government will NEVER collect a penny, euro cent, or centavo off me abroad, NEVER.
It’s just not understandable why the US Government wants its own citizens abroad hating it. Instead of having an army of goodwill ambassadors abroad, it’s now become an army of anti-American ambassadors who probably would be cheering from NJ watching the WTC coming down in front of Donald Trump.
Calgary411 is so right. Charter Trial 2016 might be our last kick at the FATCA can … we must ensure this case gets to the courtroom. We tried to describe to the Stephen Harper government, prior to IGA passage, the harm and injustice of FATCA (and CBT) but they thought (or pretended to think) that our descriptions were over-the-top. They were NOT over-the-top. We are witnessing already loss of savings, loss of LCUs, health problems, ID theft, etc. We cannot forget, for instance, what Patricia M. Anderson d’Addario went through. (Search http://fatca.eu.pn/ under Individuals.) There will be hundreds of thousands of cases similar to hers in the future when OVDP becomes OMDP (Offshore Mandatory Disclosure Program) enforced by fear, fines and bounty hunters. That’s why the ADCS and other lawsuits are vital. Let’s not let these valiant efforts fizzle for lack of funding.
@ Furious AC
( Consider how our leaders and plaintiffs must feel about having to plea constantly for donations, they are human , too, and involved daily in the struggle to free us all)
Well, Furious, that spoke to me.
I can’t speak for Dr. Kish, who daily writes creative posts to encourage donations to keep flowing.
But I can tell you how I feel. I feel humiliated to have to keep begging- yes I used that word- for donations. I have never in my life asked another person for a penny. I never lose a night’s sleep about what the USG plans for me, but I can tell you every day when I read the headline post and see the outstanding debt, my stomach churns. It also saddens me that we rely on the same generous folks here, time after time, though we are so grateful. Where or where are the others? Gwen and I and the committee will do this work everyday for everyone so affected, for as long as it takes. It is the choice we made and we have no regrets. I did not have a moment’s hesitation when I offered to be a plaintiff, even with the public disclosure required of my personal identity and financial affairs. That’s how strongly I believe in this cause, as do the donors.
I do not want to let you down, I do not want to disappoint you, I do not want us to fail at this point and have to stop this litigation. We have come so far! We can take pride in this grass root organisation that has already shown the Canadian government that our voices will be heard in every court that will hear us because our cause is just and right. They are using our tax money to fight us, which is disgusting and means we are paying twice. Let’s not be cowered by that. Let us continue to support each other as we get this done.
As you have placed your trust in two plaintiffs and a great committee, so I have placed my trust in you. Please be there for me/us.
Being a litigant is not hard for me. Writing this post, was.
I shouldn’t let this slip but I will. Other than the charter toilet paper, We are working on real estate type signs showing that the charter is for sale and was sold to the highest bully. After all, if a judge is biased for worrying about what the USA will do to Canada if he/she rules in Canadian’s favor, then the charter has been sold!
@ NativeCanadian
Perhaps you should slap a SOLD banner on that real estate sign.
Ginny, that was the whole idea. A Real estate sign with the big red SOLD across it possibly in red white and blue lettering. We would also need a group picture of ALL immigrant groups races, creeds etc. who all came to Canada with the same SOLD sign on it as well….
@ NativeCanadian
😉
If “Dog the bounty hunter” comes to my door, he will be neutered and sent home, I guarantee it!
