March 8, 2016 UPDATE: Legal fees paid — on to Federal Court for Charter trial contesting Canadian FATCA IGA legislation.
Canadians and International Supporters:
You came through once again: $594,970 for legal costs have now been donated and our outstanding legal bill is finally paid off.
Thanks especially to those who donated even though they never had any “spare” money to give, and despite this gave over and over and over again.
This last round of fundraising also shows that our Canadian lawsuit remains dependent on the kindness of our International Friends: There would be no lawsuit without their financial help.
Know that a very generous donation (today) from a supporter in the United States made it possible to pay off the remaining legal debt. Also please appreciate that there would be no lawsuit without the help of the Isaac Brock Society which has kindly let us use its website to solicit funds.
Our next step is the Constitutional-Charter trial in Federal Court.
For this we need more Canadian Witnesses, and my next post will be devoted only to a request for Witnesses willing to go public, like our Plaintiffs Ginny and Gwen.
For the future: I want a win in Federal Court — and I want the new Liberal Government not to appeal that win.

“Today (November 30) The Justice lawyers responded by saying that their instructions from the defendants have not changed.”
This might merely mean that the new Government has not yet had the chance to properly consider their position. We shall see. In the meantime, IF it were not so politically incorrect, I would shout with inclusive amendment “Onwards Righteous Soldiers” !

I bet that the vast majority of that figure comprises Penalties (including FBAR penalties) and not tax. Secondly, the FEDERAL ONLY debt of $18 Billion and rising is DESPITE those collections …. so no dent at all.

I am both shocked and not surprised by the response of the Minister of Justice. I feel like a refugee without a refuge … in my own home. But then I’ve felt like this for the past four and a half years so nothing has changed. And nothing ever will without the fight that is being mounted here.
It’s up to the “Whos” in “Whoville” on their little dust speck to make some noise … and a difference.
I’ve said it so many times before…. We are worth less than money. This is all about money plain and simple. The new Liberal government has shown Canadians they are all liars and will continue. Is this, then, the final and, if so, under-handed reply to our queries, our encouragement for the Liberal government to be a different and responsive government to and for ALL Canadians, delivered not by the new Prime Minister, not by the Justice Minister, not by the Minister of National Revenue? Is this our message, delivered by the new government’s lawyers as a PS in an email to Joseph Arvay, that *A Canadian is a Canadian is a Canadian* really only refers to all other Canadians, not those with some deemed relationship with the foreign government that pulls the strings (i.e. CONGRESS, not Parliament, shall do the speaking and the financial institutions shall have precedence over *the people*), the foreign government that laughs at the idea of Canada’s sovereignty?
To my Canadian-born children, my apologies for what I have wrought for you in my ignorance of US citizenship-based taxation. I am deeply saddened for any US heritage that is passed on to you for, with that heritage, is that consideration that you are enslaved. My son, I am sick that I cannot somehow and for some more of my Canadian retirement dollars remove the stigma and US CBT entrapment from you or those that should look after your best interests. You seem to have only a vague Canadian promise that your registered accounts do not have to be reported to the CRA by our local Canadian *foreign financial institutions* to then be passed on to the US IRS — only the weak round-about way of saying we (US citizens who happen to abide in Canada) are given permission to use *tax evasion* as our means of sweeping under the rug the fact that there remains the US requirement for US tax returns, with Forms 3520 and 3520A, as well as FBARs to the US Financial Crime Enforcement Network to be filed on behalf of you, a Canadian-born US-deemed US citizen who has never lived a day in the US nor has ever received any benefit from the US. This, as the IGA that implements FATCA in Canada, is no protection for you and a precedent set for Canadians from other nations.
I rail at why *Accidental Americans* like you (though not as identifiable as those born in the US to Canadian parents, but still as eventually affected in the US quest to find all their chattel) had no say or *claim* or choice in your deemed US citizenship. None of your parents would have or could have seen this result for you as a non-meaningful status is foisted upon you. I curse anyone who does not see this as an injustice — like those in the US Department of State*…
I will continue to support the litigations that may eventually bring some common sense and just decision of the fate of you and others like you. I am indeed saddened that the Canadian *Charter of Rights and Freedoms* does not pertain to ALL Canadians, that some will still be second-class to any other Canadians because of their place of birth or that of their parents. What a waste of other more important causes we should be supporting as Canadians, whether *old stock* or persons who have CHOSEN Canada to be their country.
You and your sister have 1/8 of North American Native blood in your veins. It is time you learn that this IS, again, the definition of *forked tongue*.

Why are you continuing to defend a law that effectively discriminates — and is probably a Charter violation — against 1,000,000+ Canadian citizens?
I’m surprised. I was actually very hopeful. The government must believe that they can actually win this. Very scary.

Working on one, Tim. Just got off the phone with my Congressman’s office. Apparently Mr Posey voted against HR 22. My queries about that, his position on RBT and just what kind of reciprocal info the IRS gave the CRA about Canadian residents are moving “up the chain”.
Whatever that means.

I think a HUGE campaign of information needs to get out right away showing how the Liberals lied to get the people’s support. The writings of Liberal MP’s and the written response I received from my Liberal MP and the letter to Blaze from Justin Trudeau himself need to be front page news. These dirty people all lied and, yet again, left the voter for stupid. In my lifetime, this needs to STOP. My daughter is depending on me and all of us to force these people to be credible. This news is terrible in so many ways. We are not even important enough to be given a direct answer….. words can’t explain how my family feels right now!

The real problem is the Canadian Public Service. In the past I have made public calls for termination of employment of certain pro FATCA public servants. However, this was strongly objected to be many Brockers who themselves are public servants such as Stephen because it could open the for pro FATCA-ites to call for people like Stephen to be fired for opposing FATCA.
NOTE: Once upon a time in a place far far away I personally had the opportunity to become a government civil servant however, I turned it down because I thought the government civil service was inherently corrupt.
Someone please refresh my memory. Is the purpose of our lawsuit to kill the entire Canada/US FATCA IGA, or just the portions that capture Canadian citizens/residents?

You state that the Arvay group has been told ” the new Attorney General and the new Minister of National Revenue (the defendants) have not provided new instructions regarding our lawsuit”.
Does this definitely mean that they have considered the issues carefully and have decided to go ahead with challenging the lawsuit OR does this mean that they are currently overwhelmed and have yet not had time to do a thorough review to make a proper decision in this regard and need more time before they make a determination one way or the other?
This distinction would be important before anyone sends out letters of appeal / complaint to any MP or government office.
Please clarify and make certain so we know how to proceed. Thanks

LM asks some good questions. We have no way of knowing whether Ms. Raybould knows anything about FATCA.
Has she personally read any of our letters?
Does she understand this impacts Canadian citizens with no financial connections to the US?
Our current PM thought fatca only impacted people in Canada with US income.
While it may be difficult to absolutely interpret the Government’s ( non) response: have they not had a chance to consider or have they rejected the idea outright?
It is important that we have told them and put them on notice that we are now advancing our law suit. They have the opportunity at any time to stop this law suit.
It is entirely up to them. What is very important is for them to know we are serious about this. The ball is now in their court.
One letter from them is all it takes for them to halt this nightmare. Your letters have told them everything they need to know in order to make a decision.
They need to hear we will never back down until they do rectify this and uphold our Charter rights and the sovereignty of Canada.

(c) I order to get a “Get out of Jail Free” card from the US government we need a Supreme Court ruling that states the IGA is forbidden by the Canadian Constitution.
