[This post, which began in May and having over 1000 revisions and 2000 comments, is being retired from service and updates. It lived through the success of reaching a total of $500,000 in donations from our kind, dear supporters who had little money to give, the hope and disappointment with the summary trial decision, and the certainty that we are now finally moving on to the Charter trial.]
CANADIAN CHARTER TRIAL UPDATE:
— We have instructed the Arvay team to prepare for the “Constitutional-Charter” trial. This means that our focus now, as it was in the beginning of our lawsuit, is on the Charter trial.
Unless there is a new expense in the future that we have not anticipated, the monies from your donations will be sufficient to take us through the “constitutional-charter” trial in Federal Court. However, to pay other legal bills we will need additional donations from our supporters, and a request for donations will appear on another post soon.
OUR LITIGATION HISTORY:
One year ago, on August 11, 2014, Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples.
Because of a Government delay we initiated a “summary trial”, using a portion of the arguments, which offered the possibility of preventing private banking information from being turned over to the IRS before September 30, 2015. … but I hope it’s good news for Ginny and Gwen that Judge Luc Martineau was appointed to federal court before Stephen Harper became PM.
May God Speed our Plaintiffs, our Team Arvey, our Brockers and our Team ADCS-ADSC in this brave effort.
May God grant Mr Arvay the language and the approach to show the Judge the path of Righteousness.
May God please grant the Judge sufficient Clarity of Thought and Wisdom to understand the issues before him or her and to rule with Uncorrupted Justice regarding the various Motions and the Summary Trial.

In my Prayer Post asking for God’s aid this morning in Vancouver I see that I omitted to ask the Lord to Confound and Confuse our Opponents. It would be of great assistance I suppose were our Opponents seen by the Judge to be confused and unsure of themselves. We can but pray for the guidance of the Lord in these matters.
May the laws of this country defeat the corrupt and criminal government in control. I’m right there with you in spirit and will be checking in today to see the results. Regarding nervousinvestor’s plea to “ask the Lord to Confound and Confuse our Opponents”: we could certainly consider them slanderers. We might adapt the Jewish prayer against slanderers appropriately: “And for slanderers, let there be no hope; and may all wickedness perish in an instant; and may all Your (our) enemies be cut down speedily. May You speedily uproot, smash, cast down, and humble the wanton sinners – speedily in our days.”

May I also second your wish for our Brockers to have a safe and successful demonstration in Vancouver IF they have time …. I do so hope that the Brockers will be busy attending and reporting news to us from court and observing the Judge concurring with Mr Arvay and rolling right into the Summary Trial.

Even though 7 of the 9 judges on the Supreme Court of Canada were appointed by Harper the court has often ruled against his government’s positions. The Chief Justice (Beverley McLachlin) is not a Harper appointee but if we don’t send Harper packing in this coming election he will be able to appoint a new Chief Justice in 2018. Harper tried to sneak in a judge who was supposed to be a member of the Quebec bar but was not. It didn’t work because the Supreme Court itself rejected the man (Marc Nadon) on the grounds that he was ineligible. Quite extraordinary. I hope there’s still hope in our judiciary but who knows.

No Gwen and I were not cross examined ( which I would not have minded) because our affidavits were straightforward and the summary trial is more about the battle of the expert witnesses.
I have complete faith in our excellent legal team. The judge is my wildcard.
Unfortunately I couldn’t make it to the courtroom this AM, but am on my way in. With any luck I won’t be demonstrating this afternoon and things will go on as planned. Don’t think I’ve ever refreshed a page as much as I have this one…

Ain’t it always the Judge who can make or break a case – fairly or unfairly – and cause an outcome to be either Justice or In-Justice by the decisions they make along the way. Arvay seems a persuasive voice however – May God give him the strength and the wisdom to shine the right light on the relevant matters to achieve the right outcome.
