Dear Supporters,
Many of you probably predicted that I would not be saying this today, but this message is not a dream: You came up with yet another $100,000 payment — now making a total of $400,000 provided to the Arvay team.
In the last twelve days you actually donated more than $40,000 — an amazing achievement for small donors. This accomplishment proves to all those people who want us to fail — that we are very determined.
You gave until it hurt and then you gave a lot more. It’s hard not to get teary-eyed over the generosity of our supporters, who have come through every time.
We know that the pace of your litigation is painfully slow, and this is unfortunately as expected. The Government will continue to do its best to slow down the process, but we now have the assistance of a case management judge to help keep the process moving more fairly.
We filed in August 2014 and it has taken a very long time (one year) before we are finally into a (summary) trial (August 4-5, 2015). We cannot predict the outcomes of this trial, based on only part of our arguments and, with your continued support, we will prepare for all possibilities.

Certains d’entre vous avaient probablement pensé que je ne pourrais pasvous annoncer une si bonne nouvelle aujourd’hui. Mais voilà : ensemble, nous avons réussi à ramasser un autre montant de 100 000 $, ce qui fait un total de 400 000 $ à remettre à l’équipe de MeArvay.
Dans les 12 derniers jours seulement, vous avez donné plus de 40 000 $, un exploit tout à fait extraordinaire pour des « petits donateurs ». À tous ceux qui souhaitent nous voir échouer, cette réussite prouve que nous sommes des plus déterminés. Et que nous réussirons.
Vous avez donné jusqu’à ce que ça fasse mal, puis vous avez donné encore. Difficile de rester insensible devant une si grande générosité.
Nous sommes bien conscients du fait que notre litige avance de façon péniblement lente. Malheureusement, tout ça est normal. Le gouvernement continue à ralentirle processus, mais on nous a maintenant attitré un juge responsable de la gestion de notre dossier qui veillera à ce que le processus progresse de façon plus juste.
En août 2014, nous avons engagé une poursuite contre le gouvernement canadien. Près d’un an plus tard, nous avons enfin la date pour notre procès sommaire : les 4 et 5 août 2015. Impossible de prévoir le dénouement de ce procès, basé uniquement sur une partie de nos arguments juridiques. Mais avec votre appui, nous serons prêts pour toutes les possibilités.

I do have a question about the timing of the next bill that is due. It is said to be due on August 1–the final $100,000 retainer. Ordinarily when a bill is due on a non-working day it is deemed to be due on the next working day. Since Aug 1 falls on a Saturday, and Mon Aug 3 is a holiday (Civic Holiday or BC Day in BC), the next working day is Aug 4–which is actually the day our summary trial begins.
Can it therefore be assumed that we are now assured of Arvay’s continued representation at least through the summary trial–given that the first four retainers have now been paid and the fifth retainer can’t be considered late until after the summary trial has already begun?
Of course we will want to assure Arvay and his team of our continued commitment to this action by making the final retainer on time, too–but it would be a big milestone if we were assured now of at least having our first real day in court.
And happy birthday to Gwen as well! Glad we’ve gotten that other person’s birthday behind us.

@ ADCS team: Could we just enjoy a topped up thermometer for a day before it drops back to empty and we have to start collecting for the FINAL installment? There’s been so much drama in the past TWELVE AMAZING DAYS OF APRIL that I think we all need to take a few deep breaths before we “Surgite!” again to the August 1st deadline.

You are giving us all a voice in this outrage.
Time is on our side. As time goes by, more Canadians will harmed by FATCA – including those still unaware of it now. As time goes by more Canadians will be harmed by the mandatory “national origin” discrimination the Harper Cons cowardly agreed to. More Canadians will support the lawsuit. Our numbers can only increase, because there is nothing mitigating the harm. It will only get worse.
Going to court in a summary trial will raise the profile as well. We should all be prepared to wage a “Public Relations / Letter-writing / Twitter / Facebook / Comment / Lobby Your MP” campaign as the suit is mounted.
All it takes is $10 each from 10,000 so-called “US persons in Canada” to reach the target.

Agree fully with this! We can’t take that long a break as Aug 1 will be here before we know it–but I hope everyone involved will at least get a chance to enjoy the weekend before a renewed “Surgite!” in the coming weeks.
Mr. Richardson hinted today that there are plans under way regarding a CBT law suit! If this is true, I would donate every last extra cent I had to this. This needs to happen yesterday. I think the FATCA law suit is a great start, but if we defeated CBT, that would kill two birds with one stone, CBT and FATCA!

John Richardson, co-chair of the Alliance for Defense of Canadian Sovereignty–the group that is organizing the current legal action.
Just a guess but I suspect we won’t see any more lawsuits until the current one is fully funded–especially given that we came close to the wire on this payment–unless a specific deep pocketed donor came forward with a specific offer to fully fund one specific new action. Otherwise, it is likely to be the same relatively small group of relatively small pocketed donors donating to any lawsuit that might be filed so any new actions will dilute that donor pool to the point where neither lawsuit would succeed.
I suspect the ADCS effort is seen as the one with the biggest bang for the buck so far–the most likely to succeed for the minimal (albeit large from a small pocketed perspective) cost. Once this effort is fully funded I suspect we’ll see more opportunities to donate for those inspired to continue the fight.
Again–these are just my thoughts and I could be wrong about the strategy being employed here–just a guess on my part.
