Many of you probably predicted that I would not be saying this today, but this message is not a dream: You came up with yet another $100,000 payment — now making a total of $400,000 provided to the Arvay team.
In the last twelve days you actually donated more than $40,000 — an amazing achievement for small donors. This accomplishment proves to all those people who want us to fail — that we are very determined.
You gave until it hurt and then you gave a lot more. It’s hard not to get teary-eyed over the generosity of our supporters, who have come through every time.
We know that the pace of your litigation is painfully slow, and this is unfortunately as expected. The Government will continue to do its best to slow down the process, but we now have the assistance of a case management judge to help keep the process moving more fairly.
We filed in August 2014 and it has taken a very long time (one year) before we are finally into a (summary) trial (August 4-5, 2015). We cannot predict the outcomes of this trial, based on only part of our arguments and, with your continued support, we will prepare for all possibilities.

I wonder if this is happening in Canada. When you sell a capital asset, your home/condo/property/cottage, etc., your lawyer places the proceeds into a trust account. If trust accounts held by lawyers are required to be FATCA compliant, that means the IRS has access to every single $. Thanks to the Obamacare tax (ACA), there is a 3.8% tax on capital gains which cannot offset by any capital gains taxes paid in Canada. Is there any way around this?

In April 2015, those references are not appropriate.
I am a Citizen of the nation where I live. When people hear an accent, I let them think I am originally from some other english speaking country.
I am ashamed of my former US Citizenship now long relinquished.
I am fearful for my children being outed being accidental americans. I have had to have the “long talk” with my children on what they can and can not say in public, I am thankful they have shed their former accent.

I have had to have some long conversations that know my families dirty secret and past.
I have shown them all the literature and the IBS.
They were shocked.
I have had to beg them to literally never disclose the family secret as it could cause tremendous harm to this otherwise law abiding, resident tax paying, lower middle class family partly dependent on benefits from my country of residence.
I hear you George. My 15 year old son is well versed on this. I went with him to an RBC branch to get some US$ for a trip to his Aunt’s in the US as she had invited him. When the teller asked if he was going to visit family, he promptly answered “No, I’m just going to see a friend.”
I was really proud of him. He understands this is something to be hidden.
…there are simply still too many who think the tax revenue of a few is worth the liberty of many. It is they who make our plight about taxes, not us – as if our citizenship is based on taxation, not Liberty.
So, I’ve hit the $1750 mark in total donations. I could have bought a lot of groceries for my 3 teenagers with that. But before anyone thanks me, I have to say that it’s not technically a donation, if I am one of those who benefits from the lawsuit.
Hopefully everyone who is directly affected by this, as I am, digs deep – if not for others, than for yourself. Who would you rather give money to – compliance condors, the US government, or YOURSELF?
I’m mailing another cheque to ADCS today. I hope this one gets from the Canada Post box in Toronto to the ADCS address in Toronto faster than the last one did. That one seemed to take more than a week. Maybe I should deliver this one personally, but I will given Canada Post another try.
Also, I’m wondering if my bank has noticed my cheques to ADCS and from that might suspect me of being a “U.S. Person” for tax purposes. I’m not. I am strictly Canadian and have a CLN to prove it. So I have nothing personally to gain by supporting the ADCS charter challenge. I really do believe this is an issue of Canadian sovereignty which the Harper government has given away. Shame on them.

My family lived through the issue in Germany…. many died… but people don’t like the comparison…. the ones who lived through it says its the same thing… that they never thought they would go through it a second time in their lifetime… We are a mixed family of US persons & 1st class citizens… We are careful… even the children… Sad part… some of the *secret* accounts were from the war that was smuggled out… passed down from generation to generation… or money/property rec’d from foreign gov’ts we were able to recover from what was legally stolen from us… took yrs to do… that never touched US soil… So what a previous war was unable to get from my family, the US is trying to clean us out now by making us pay and give them a road map with a knife to kill us off…

Actually, they have made it impossible to hide. Any interaction you have with a financial institution, whether it’s a bank, ins company, credit union, etc., you will be asked the question.

U have to legally prove u are not a US person everywhere in the world… I have family elders who have some of their children in the US… their financial mail is sent to their children or the children are joint holders… nothing belongs to the children yet… that has openned a can of worms we never thought of… a simple address in the US was never something we thought would be a big deal… guess what… it turns out it is and the biggest mistake ever made… their accounts were frozen or shut… try living without access to financials…. we can’t even send them funds… we had to carry funds to them… we can’t even send it to someone to pass it to them… it will taint them… In some countries… very limited bank branches… if u are tossed from one or a trace of US person… no one wants u. Thanks to the US… US persons are now considered unwanted trash world wide

I agree with you but just to tell it like it is: the “worldwide enablers” essentially means every government on the planet–and every political leader on the planet with a chance of forming their country’s next government. (If I’m wrong on this–and there is someone somewhere taking a strong stand against FATCA who actually has real political power–I would LOVE to be proven wrong by being told who that person/leader is.)
There are individuals involved here whom I am very proud of: the two brave plaintiffs, Ginny and Gwen, the ADSC-ADCS team, and all the donors. But there is no country on the planet I can be proud of at the moment based on the behavior that we’ve seen. If there were, I would gladly move there in a heartbeat. There is also–to the best of my knowledge–no big, mainstream, institution anywhere on the planet offering anything more than the feeblest opposition to FATCA. Even though FATCA is very bad for business, we don’t see the business community, government or opposition political parties, or deep pocketed individuals taking a stand here.

The NYT article is long and detailed. Read the whole thing. Among the details, which, of course, focuses on the deals dating back to 2005 and onward and how that may have influenced various deals, especially the Uranium One deal. The devil is always in the details.
So, DEEP Canadian pockets DO donate to issues and favourite entities all the time.
@US_Foreign_Person – I just read your comment to George about how some of your “hidden” monies were from (and after) WWII and was so incensed. This issues should be seriously raised with a range of Jewish organizations inside the US and in Europe; they probably have no idea about this aspect – – it is up to you (and others in this situation) to inform them in detail!!
I have several times tried to reach out to Rabbis (most in Canada are from the US) and the Canadian Jewish News to encourage them to inform others about FATCA, but to no avail. What you have described is awful and protest over this situation needs to be taken further than just sharing your story with George and all of us at IBS.

We have not kept this a secret… spoke to many… who all say… sorry to hear… then brush us off… no one is interested…
We are not the only family in this situation… Funds were added… small amts.. but it adds up over the yrs… this money has been handed down… generation to generation… each generation added to the fund… this is our family legacy… from our family that didn’t make it through the war & were killed like animals… to ensure the family who did survive… had something… we could remove our names & turn it over to the non-tainted… but its too late… we have our finger prints all over it.. not easy to wipe off…

I have a couple of questions about the hearing that I understand is now scheduled for Aug 4-5, 2015:
Will this hearing be open to the public? If so I might take the time off work and make the trip up to attend–it is only about 150 miles away.
Is this hearing the summary trial itself or a pre-trial motion relating to the summary trial? The wording that was posted briefly here on Brock (now deleted) and the wording at the Court site itself (http://cas-ncr-nter03.cas-satj.gc.ca/IndexingQueries/infp_RE_info_e.php?court_no=T-1736-14) differ slightly.

Perhaps a better way to describe it would be that:
“Every person who the U.S. DEEMS to be a “U.S. person” is a “hunted species”.
Today, many members of the “hunted species” do NOT consider themselves to be “U.S. persons” at all.
Tomorrow, the class of persons who the U.S. deems to be a “U.S. person” is likely to be larger than it is today. Go figure.
Every action causes a “reaction”.
