UPDATE January 24, 2015: THIRD OF FIVE LEGAL BILLS PAID
[We now have a NEW POST taking us up to May 1, 2015. This post will be retired from service.]
On August 11, 2014, Constitutional Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples worldwide. Read Alliance’s Claims and comment on our Alliance blog.
Merci !
L’équipe de l’ADSC

Dear Friends and Supporters,
Together we have reached our goal of paying off the third of five retainer fees for our Canadian FATCA IGA lawsuit.
Raising $300,000 from small donations is a pretty amazing achievement and we ask the Government of Canada, and those other governments who have also tossed away rights of their citizens, to take notice.
It’s still a marathon, but we are more than half way to pay off the Federal Court legal costs.
We have come so far because of our brave Plaintiffs, Ginny and Gwen, our Canadian and International donor-supporters, and the administrators of the Isaac Brock and Maple Sandbox websites who make it possible for our voices to be heard.
Thank you all,
—The ADCS-ADSC team
@Jeff D. T. Thank you for the poem by DT…quite à-propos. I will do a reread often. A shout out to our persistent Brockers in achieving our 3rd goal. We might be small but we are mighty and historically small and mighty has always had an big impact.
On the other end of the literary spectrum is the wonderful children’s book by Dr. Seuss called “Horton Hears a Who!”. http://en.wikipedia.org/wiki/Horton_Hears_a_Who! We are all residents of “Whoville” and we are shouting as loud as we can. We’ve just turned up our volume and over the next months the world will be hearing more and more from us as the next two thermometers fill to the brim. Congratulations, everyone! Well, well done!
Thanks, Jefferson D. Tomas! Dylan Thomas’ words resonate these years later.
I don’t know if this would be the right thing to do, but consider going on http://www.prweb.com and throw a pr release about how “IBS succeeds raising another $100,000 to fund anti-FATCA lawsuit in Canada” etc etc.
When a release is done on PRWeb, when somebody goes to google news FATCA, odds are it will show up.
This may provide further ammunition to contentions that the banking, personal and other information collected and remitted by the banks AND insurance companies (for certain life insurance products), and other FIs and Non-FIs to the CRA is a violation of our right to privacy and security of the person, and against search and seizure, etc.
See current development re Obamacare portal and collection and dissemination of personal information with advertisers and commercial interests:
US government gives personal data collected under Obamacare with advertisers and commercial interests:
‘Government health care website quietly sharing personal data’
By RICARDO ALONSO-ZALDIVAR and JACK GILLUM

“The government’s health insurance website is quietly sending consumers’ personal data to private companies that specialize in advertising and analyzing Internet data for performance and marketing, The Associated Press has learned……”………
” connections to dozens of third-party tech firms were documented by technology experts who analyzed HealthCare.gov and then confirmed by AP. A handful of the companies were also collecting highly specific information. That combination is raising concerns.
Leading lawmakers on Tuesday asked the administration to explain how it oversees the data firms to make sure no personally identifiable information is improperly used or shared.
“This new information is extremely concerning, not only because it violates the privacy of millions of Americans, but because it may potentially compromise their security,” Sens. Orrin Hatch, R-Utah, and Charles Grassley, R-Iowa, wrote to the administration.”………..

So Hatch and Grassley are concerned with the privacy violations and security compromising of millions of Americans under Obamacare. Are they not concerned with the privacy and security and identity threats to those abroad that FATCA poses to individuals, families and businesses?
@Don, that is an interesting idea.
I second that @Don and @WhiteKat. Perhaps ADCS has already considered that or something very similar.
Don’t know how much it costs to put something on PRWeb, but having brought and funded the legal challenge this far – mostly due to many small contributions, shows that the anti-FATCA IGA position has traction – and that is something to celebrate and trumpet for sure. Individuals have put their savings, their time, energy and efforts into pursuing justice and asserting the rights that our Canadian Constitution, Charter of Rights and Freedoms, and laws have codified. Our own government cannot abrogate those at the whim and behest of a foreign power and extraterritorially compel Canadian citizens and residents to cede those rights under duress.
Also valuable to show those in other countries that there is tangible and increasingly organized and funded opposition to FATCA as imposed extraterritorially by the US and implemented by the IGAs. Also timely to point out that there still is NO evidence of any equivalent reciprocity from the US, and no evidence of any authority for the US Treasury to have entered into the IGAs to begin with, as the IGAs were not part of FATCA as legislated. The US Emperor has NO clothes – only extortionate might to use FATCA as part of what is being termed the “weaponization of finance” http://www.businessinsider.com/weaponization-of-finance-eurasia-group-2015-1 – a weapon that in the instance of FATCA is turned indiscriminately on allies like Canada, and foes alike.
Oppose the FATCA “weapon of finance” the US has pointed at Canada and other countries – and the implementation of which our own home governments are funding – for example, here in Canada via the criminal waste of our own Canadian taxes via the CRA FATCA implementation, and the government’s taxpayer funded defence against the ADCS legal challenge.
Get ready to send ADCS a Valentine to fund the next installment of the legal fees – and to the brave plaintiffs Ginny and Gwen who have agreed to take on the burden of being the public face of the legal opposition.
If IBS goes down the PRWeb route, consider publishing the press release in other major languages perhaps obviously English & French, but Spanish, German, Portuguese etc.
Mandarin is the most spoken in the world. Spanish is actually more widely spoken than English according to the Wikipedia page.
http://en.wikipedia.org/wiki/List_of_languages_by_number_of_native_speakers
Now that’s native speakers, but English included as a second language would probably be first or second worldwide. The research hasn’t been done, it’s a guess.
Also perhaps an information video on YouTube. Four years ago I put up an anti-FATCA YouTube video and it was seen across the world in was in the top 10 videos for a long time.
@JapanT
Don’t forget…. *US Person* also include all who held or hold a GC or a visa & did not exit the system…. Most asians like the idea of having options so they can grow their futures… never thought it was a big deal to get another citizenship or a residence… The US has now made it very clear… we are their tax slaves also without representation…
Any Greek Brockers???
We could probably get Syriza on our side in Greece as they just won the election.
@Don @Whitecat. I have done a number of PR releases through PRWeb – last about two years ago. If done right you could rank high up for “FATCA” for perhaps three days and with a picture in the search results as a news item – if done right as in “FATCA” in the title and sprinkled throughout and in the URL, preferably first word of URL. The release would rank for other words. The cost is a few hundred dollars. I’ve used these to prop up the rankings of websites with links to them.
There are a number of articles on FATCA. Many allow comments. There could be more mention of ADCS, Isaac Brock, and fatcalegalaction and this is all $0.
IMO the tally of donations should continue throughout January – let’s see if we can beat the amount over the target as the last installment.
@JC Don and Whitecat: Just a suggestion! Can we pool funds with AARO or the fatcalegalaction for the PRWeb? Not sure how that would work but after all we are all US tainted. Everybody wins.
Re: The last two retainers, May 1 and Aug 1.
Are these two retainers required to take this litigation to the Supreme Court of Canada, or the BC courts?
@Marie,
The May and August retainers (the “Federal Court retainer costs”) will take us through the Federal Court only. We expect that this case will be appealed to the Federal Court of Appeal and to the Supreme Court.
The costs for the appeals will be less. We will find the money.
Congratulations team Brock!
This is off topic, but I think a few might be interested in Rocco Galati’s Supreme Court challenge set for tomorrow. He will be making a second attempt in persuading the court to reinstate the use of the Bank of Canada.
Bravo, I knew we could do it!!!!!! 😀
