We have now incorporated a Canadian non-profit organization with Corporations Canada:
“Alliance for the Defence of Canadian Sovereignty (ADCS)/L’Alliance
pour la défense de la souveraineté canadienne (ADSC)”
ADCS/ADSC is not affiliated with any other organization.
The present Board Directors are listed below. Other individuals critical in setting up ADCS/ADSC are Gwendolyn Brock, K. Badger, and many others. Lynne Swanson will chair the legal challenge committee.
The overall purpose of the Corporation is to defend Canadian sovereignty and protect all persons in Canada from the attempts of other countries to impose their “extra-territorial legislation” on Canada.”
Its immediate objective is to fund a legal challenge to oppose changes in Canadian laws that would impose the U.S. FATCA law on all people in Canada.
Given that the Canadian government has extensive financial resources (courtesy of the taxpayers of Canada), significant monies need to be raised. We are counting on your support.

Good idea to defend Canadian sovereignty, however, in the instance of this onslaught from down south the most effective strategy is, I believe, to attack the problem at its source, i.e., form a U.S. Constitutional Challenge against CBT, FATCA and Foreign Accounts Reporting. But the head of the snake off, instead of teasing with the tail?

Great idea! How about a two pronged approach? The Canadian alliance should garner a lot of support locally, but your idea could get groundswell support from around the world.

CBT, FATCA and FBAR are US laws — foreign law being allowed into Canada to take precedence over Canadian law. The fight on that end has taken place and continues with submissions to the US Ways and Means Committee, US Senate Finance Committee, etc.
This challenge, however, is directed at FATCA IGA implementation to be passed / passed by legislation in Canada. The government omnibus Bill C-31 makes Canada complicit by allowing enforcement of US law in a SOVEREIGN (or formerly sovereign) Canada.
One of the biggest reasons to fight this in Canada is for the precedent that it will set. It is the US hunting for its “nationals” now. What country will it next be?
ALL Canadians should be concerned about the rights of US Persons in Canada under the Charter of Rights and Freedoms being waived, defining them “Americans who happen to reside in Canada”. This means they are second class to any other Canadian no matter their national origin or the national origin of their parents or grandparents. It is discrimination and abuse of human rights on many levels. What country will then have their rights waived?

I am also grateful that there are so many people supporting this very important stand against FACTA and the IGA. It’s our Constitution at stake and who knows if we don’t take a stand now what will the future hold for our independence. I raise a glass to all people involved and fight on we will!

The 1995 USA Canada Tax treaty has already set the precedant of recognizing CBT in Canada.
The CPA will collect against people who were not citizen at the time.
If The Canadian Supreme Court ever reverses the Revenue Rule every other “US person” will be subject to actual USA tax enforcement in Canada,. This is extremely unlikely but killing the 1995 USA Canada Tax Treaty should be included.

[E]nforcement of a claim for taxes is but an extension of the sovereign power which imposed the taxes, and . . . an assertion of sovereign authority by one State within the territory of another . . . is (treaty or convention apart) contrary to all concepts of independent sovereignties.220
This convention is called “the revenue rule.”221
Effective November 8, 1995, the Canada-US treaty was amended to override the revenue rule and provide for each government to assist in the collection of taxes owing to the other government.222 For the CRA to accede to a request by the IRS in respect of US taxes owing by an individual,
n the taxes must be “finally determined” (not subject to further rights of appeal), and
n the individual cannot have been a citizen of Canada during the period in which the tax debt was incurred.
When these conditions are met, the CRA will collect the US debt as though it were a debt owing to Canada.
I was chatting with my husband about FATCA and what India is trying to do with Switzerland and he said it reminded him of what happened during the Great Depression when countries started becoming protectionist and imposing tariffs on one another. These actions actually made the Depression worse and last longer.
What the US has done with FATCA will launch a trigger reaction from all other countries against the US and against each other. First the US threatens all countries with 30% withholding on all transactions coming to them from the US. Then a country like India feels emboldened by this and threatens Switzerland with 30% withholding on EVERYTHING if they don’t hand over the financial information of all Indians who have bank accounts in Switzerland.
It will be like dominoes, all countries desperate for income will start 30% withholding on all money leaving their country. It will get so bad that all international commerce will grind to a halt making this already horrible Great Recession turn into a Great Depression.
Idiots always repeat history and just like during the last Great Depression the US is the lead idiot.

you have my support in spades. I am very nervous about the US. they feel entitled to do with us as they wish. keeping us hanging over keystone. letting their citizens think they don’t want it, and under their breathe they crave our oil, and need it, and want it badly. I don’t trust anything about their government, the CIA, IRS. all corrupt to the core. it is all smoke and mirrors. Oh, and by the way, I don’t trust our government any more either. There was a time when I truly believed that government was by the people, and for the people, and in the best interest for all. We are becoming a dictatorship, and we are in trouble. Now that we have succumbed to the threats of our closest supposed ally, other countries will start to test us too. Just wait and see, India will be the first. I bet they threaten Canada with 30% withholding if they think it’s in their best interest to do so. This is really creeping me out. Our household consists of one person born in the US and one born in India. Our son was born in Canada and thankfully he is not a US person but you never know when they might change the rules about that too.
I do not share bank accounts with any of my Indian family either in Canada or in India. However, I know that a lot of Indian families do share bank accounts with their grown children both in Canada and in India. My fear is that India will try to exploit that and say it’s done for tax evasion purposes when it’s really done for convenience and family security.

I am in and ready to send a cheque as soon as we get the go ahead. I am so proud of all you who are devoting such tireless energy. I will talk it up among my circle of friends who are not second class Canadian citizens so as to get funding across a broader spectrum. Well done. Let the fight begin! I still think we need a march prior to July 1st. Here’s hoping….
Everyone stay tuned. This has been a work in progress, from figuring out a name, to determining what type of organization it should be, to hashing out what its mandate is, and will be, in years to come. We are getting closer to having a place for everyone to go to make donations, but all of this takes time. Remember, this may be a long hard road we are about to embark upon, but it is a marathon…not a sprint. Just keep the long term goal in mind, and we WILL prevail!
