[This post, which began in May and having over 1000 revisions and 2000 comments, is being retired from service and updates. It lived through the success of reaching a total of $500,000 in donations from our kind, dear supporters who had little money to give, the hope and disappointment with the summary trial decision, and the certainty that we are now finally moving on to the Charter trial.]
CANADIAN CHARTER TRIAL UPDATE:
— We have instructed the Arvay team to prepare for the “Constitutional-Charter” trial. This means that our focus now, as it was in the beginning of our lawsuit, is on the Charter trial.
Unless there is a new expense in the future that we have not anticipated, the monies from your donations will be sufficient to take us through the “constitutional-charter” trial in Federal Court. However, to pay other legal bills we will need additional donations from our supporters, and a request for donations will appear on another post soon.
OUR LITIGATION HISTORY:
One year ago, on August 11, 2014, Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples.
Because of a Government delay we initiated a “summary trial”, using a portion of the arguments, which offered the possibility of preventing private banking information from being turned over to the IRS before September 30, 2015. Holding good thoughts and prayers for the litigation team and especially for Ginny & Gwen. For 2 women who are standing up for all of us… world wide… and our future generations….
These women are putting alot out on the line more then anyone…. yet we can’t help pay the final payment to the litigation team on a timely manner…. Even if u can only afford $5… do it… we must pay the last payment as soon as possible…. the litigation team is giving us their best…. we should keep our word & pay them…
We must stop this now…. what next.. we will have to supply our most private info then we will have to supply our dna? We have become 2nd class… no matter where u are in the world… no one gives a damn about us…. except for these 2 women… even our own families are tired of this…. Nothing is going to stop this train wreck other then litigation… So please… donate… we must fill our promise of support with payment

Today we will now hear the Feds disclose to the court just how much they don’t care about us. Should be an interesting day. Hope everyone has their blood pressure medicine on hand.

Generally each side opens with its strongest statement or argument. I’ll let you be the judge. Gwen reports the Feds have just told the court that” “we have to do what the US says cuz its the law and the treaty says so”.
And we’re off to the races folks! Hold on to your hats.
I don’t think anyone’s mentioned that Mr Gruber told the judge yesterday that he (Mr Gruber) is a tax-compliant U.S.- Canadian citizen.
Feds are now articulating their second argument which we’ve heard many times: if we didn’t sacrifice all these Americans the banking industry would collapse.

And now, quite predictably the third argument is the USA has the authority to tax its citizens. Even if they happen to be Canadian like the two plaintiffs.

Nice — Mr. Gruber, a tax-compliant US Canadian citizen! He understands completely.
And now the hat trick argument has been stated. They don’t know how many US citizens are Canadians; they are simply making us to what we are supposed to do anyway because it’s the law;and they are committed to helping them ( meaning the US) under the agreement.
I call this the push them under the bus argument.
Refreshing my computer screen constantly, and following the happenings….as much as possible from this little town of Cobourg, Ontario. Curious and fascinated as to how the defendents will justify throwing just a few of us Canadians under the US bus. Keeping my fingers crossed for a strong finish today! A huge debt of gratitude and thanks to all who are fighting to take care of those who the Canadian government has failed.
