[This post, which began in May and having over 1000 revisions and 2000 comments, is being retired from service and updates. It lived through the success of reaching a total of $500,000 in donations from our kind, dear supporters who had little money to give, the hope and disappointment with the summary trial decision, and the certainty that we are now finally moving on to the Charter trial.]
CANADIAN CHARTER TRIAL UPDATE:
— We have instructed the Arvay team to prepare for the “Constitutional-Charter” trial. This means that our focus now, as it was in the beginning of our lawsuit, is on the Charter trial.
Unless there is a new expense in the future that we have not anticipated, the monies from your donations will be sufficient to take us through the “constitutional-charter” trial in Federal Court. However, to pay other legal bills we will need additional donations from our supporters, and a request for donations will appear on another post soon.
OUR LITIGATION HISTORY:
One year ago, on August 11, 2014, Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples.
Because of a Government delay we initiated a “summary trial”, using a portion of the arguments, which offered the possibility of preventing private banking information from being turned over to the IRS before September 30, 2015. Just think where the ADCS fund would be if it could have somehow received a penny per view at Brock. Just think where it would be if every person who came to Brock for solace and information had kicked in as little as one dollar. Just think where it would be if just one someone with a deep pocket had made a commensurate sized donation. Sigh.

@ Polly — The mail can be slow even when just going across Canada. Your envelope should arrive just fine but it’s always good to alert Stephen that it’s on the way. BTW I blame Harper for the dicey mail delivery too. He wants to phase out home delivery. They are probably so busy constructing street corner mail boxes that they forget there is a job to be done. And yes there’s another court challenge about this too. It cites charter rights. Sound familiar?

If just ONE country when negotiating the IGA had requested “mirror image reciprocity” this whole mockery of justice would have collapsed.
What is “mirror image reciprocity?” Let me use a USA example and for many it will be a bad example but it explains the concept. Mirror image reciprocity applies with many US States concerning concealed handguns.
If Ohio allows concealed handguns with license and recognizes Georgia licenses then Georgia will recognize Ohio licensed people.
Ireland could have said even though we do not have CBT we would like this information on all “deemed Irish Citizens” with clinging Irish nationality, simply because it would be nice to have.
Ireland could have required that all US FI’s would need to ask nationality of client, parents and grand parents plus place of birth of all of them.
How fast do you think the house of cards would have collapsed?
Even at this late game, I think all the IGAs are up for review in 2016 and reciprocity could be demanded then.

NEW lawsuit excellent opportunity to bring more attention to ADCS lawsuit. Now 2 lawsuits against FATCA in both Canada and the US. 1st lawsuit against FATCA IGA in Canada now followed up by lawsuit in the US. Etc., Etc.
Congratulations to all on this really important milestone! I’m looking forward to continuing to support both efforts financially to the extent of my ability. And I’m looking forward to meeting some of you in 3 weeks in Vancouver.

I spoke with the registry officer at Vancouver Federal Court today. We have a court room assigned #C702 on the 7th floor. The judge is Honorable Justice Martineau.
We have about 18 people that I know of attending at this point. The court room holds 60 so if anyone else wishes to attend please let me know.

Thanks for the update. Someone awhile back was wondering who the judge will be. Maybe @badger can find some information on The Honourable Justice Martineau. I tried but I’m just can’t dig like our badger.

I found that but wasn’t sure it was the right Martineau. It looked like Justice Luc Martineau was in Ottawa but maybe these judges are dispersed all over Canada.
