[This post, which began in May and having over 1000 revisions and 2000 comments, is being retired from service and updates. It lived through the success of reaching a total of $500,000 in donations from our kind, dear supporters who had little money to give, the hope and disappointment with the summary trial decision, and the certainty that we are now finally moving on to the Charter trial.]
CANADIAN CHARTER TRIAL UPDATE:
— We have instructed the Arvay team to prepare for the “Constitutional-Charter” trial. This means that our focus now, as it was in the beginning of our lawsuit, is on the Charter trial.
Unless there is a new expense in the future that we have not anticipated, the monies from your donations will be sufficient to take us through the “constitutional-charter” trial in Federal Court. However, to pay other legal bills we will need additional donations from our supporters, and a request for donations will appear on another post soon.
OUR LITIGATION HISTORY:
One year ago, on August 11, 2014, Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples.
Because of a Government delay we initiated a “summary trial”, using a portion of the arguments, which offered the possibility of preventing private banking information from being turned over to the IRS before September 30, 2015. Yes, Dash, I was referring to the Parliament building attacks. I hate that the term *terrorism* there gives support to the likes of Bill C-51 being, again, another Bill pushed through Canada’s Parliament. Will there be those in the Senate that can stop its implementation and more shredding of the rights of the country’s people?

While I was looking for the status of Bill C-51 (Committee Report Presented without Amendment in the Senate on 2015-05-27 — 2 more steps to go and it’s law) I found a group called Open Media which believes it has an antidote. Interesting. Since C-31 and C-51 are two peas in the anti-privacy pod I think their effort will indirectly benefit our FATCA fight too.

@Embee – Thanks for bringing https://privacyplan.ca/ to our attention. I think as many of us as posssible should write to this organization (and each of the organizations which have indicated that they support these views) and explain that we fully agree with their efforts (if that is how we feel) but that we will not be able to financially donate there until our issue is fully funded.
At that juncture, each writer could thoroughly introduce the FATCA and IGA issues. Maybe, just maybe, we will strike a nerve and they will consider spreading the word to their members and, possibly, gain some supporters, especially given the timeliness of our court challenge. Who knows….. Spread the word, spread the word and spread the word some more…..

I’ve been a supporter of open media for some time now because they have had a campaign going to unseat the Tories in the next election.
They just called me the other day to ask me to donate on a monthly basis. Unfortunately I had to say that at this point I am tapped out, but told the enthusiastic young woman on the other end of the phone that I would continue to support them with my Twitter and Facebook postings.
I then explained that I am a plaintiff in a lawsuit against our illustrious government due to another one of their egregious laws buried in budget bill C-31. So now someone there does know about our lawsuit. She was appalled to hear what our government had done and wished me and all of us involved a win.
It certainly wouldn’t hurt to have more people on our end tell more people on their end about it, that’s for sure!
Almost $10,000 in one day. Amazing! It’s a gloomy, rainy day here in Alberta but I’m all smiles. 🙂 🙂 🙂 I’ll bet the ADCS team is too, thanks to our faithful, kind and angry donors.

I hope this may give ideas to Canadians and people in other countries in regards with communications with their governments. However, ultimately, as reminded to me by Allison Christians, remedy for the injustices remain a matter for the courts. Onward ADCS legal action!

Well, it was initially the beginning of the year, then it was May now it; “will not be based on any artificial timeline”. It amazes me that the legislative and judicial processes are sooooo slow yet our suffering just seems to increase at amazing speeds. Knowing absolutely zero about the legal process I naively would think if one put a few smart people in a room for a month the case could be built and filed. Reckon I am wrong.
It is difficult to criticize the RO, they are the only game in town at the moment on this issue. I am simultaneously grateful and frustrated sprinkled with a dash of suspiciousness regarding secondary agendas. At least with ADSC I never question their motives, the agenda is clear. Dealing with politicians is a whole other game in which I do not understand the rules and have very little trust. (The only thing I am certain of is that they find old ladies that have shed the need for filters rather obnoxious and they have zero senses of humour).

The federal govt has always insisted that the IGA is only a reporting requirement, and does not impose any new taxes for “Canadians” (they never indicated who exactly they consider to be Canadian). You can bet that they want to strike all portions of expert witness testimony that links the FATCA to new taxes. I’m thinking specifically of the affidavits of Robert Woods and Allison Christians.
JC: I salute you for your marvelous letter to the Australian ambassador referenced in your comment. Exceptionally well done! It’s good to know that your important statement was sent to the Senate Finance Committee. Now, let’s hope they read every word and act upon them!

I am OLD and it is beautifully freeing. You can wear a purple dress with a red hat that doesn’t match, steal other peoples flowers and beat politicians with your purse and get away with it. (Ha, Mr. Yue had no idea of the bullet he dodged when I declined his thoughtful invitation to the RNC convention).
Now it looks like I need to buy a big huge purse, fill it up to the brim with bricks and visit a few folks in the Canadian government that are denying our witnesses. No new taxes? What, they think we have all been compliant? What about the penalties? Inability to save, retire. I wonder what they would think about the US bankrupting many living in Canada and one million of us on Canadian welfare! That would require more taxes for all Canadians.
I do NOT understand how OUR expert witnesses can have portions of their testimony denied. Our experts are there to educate, speak to facts. They are OUR witnesses, they are credible and they cannot be heard?Because the facts will be counter to their position they are not allowed? Is this not justice denied? Illegal? Is this a tactic to run up our legal costs with road blocks? (I think I need another blood pressure pill I am becoming incoherent and babbling).

That person is getting conflicting and, in some cases, bad advice. The person who told him “Suggesting he delay contacting an accountant who specializes in US tax matters is absurd.” needs a slap around the head. The absolute first thing he needs to do is determine if he has performed a relinquishing act. Hopefully he takes your advice.
