[We now have a NEW POST taking us up to February 1, 2015. This post will be retired from service.]
THE AUTUMN 2014 UPDATE
Dear Donors,
Together, we reached our goal of $100,000 to pay the November 1 legal bill 11 days ahead of schedule!
Thank you Canadian donors from coast to coast and our friends from around the world for your generosity, support and determination — and especially for not being afraid.
The name of our non-profit corporation is the “Alliance for the Defence of Canadian Sovereignty.”
We were very deliberate in including in our name the word “sovereignty”, which forms a cornerstone of our Claims against the Government of Canada.
Canada and dozens of other countries throughout the world gave into a bully because their “leaders” were afraid of harm caused by a trading “partner” — and they gave their sovereignties away.
Help us convince by example the Leaders and Governments of all countries worldwide that they should return their sovereignties back to their Peoples.
Please continue to support our lawsuit.

Chers donateurs,
» (Helen Keller)

Whitekat: “My husband and I bought in a bubble in 89, never made a cent in the housing market, and are waiting out another bubble here in Ottawa”. I bought in Toronto in 92, sold in 96 and lost 10%. But in Vancouver we have stolen the bank. Just one person in Vancouver (or Toronto) who owns a house can finance this whole campaign on the equity gain over 10 years. But is this tax deductible to the IRS if you happen to still be a US citizen? I expect to donate $1K initially too. It would be nice to have a running account of total amount donated.
Well done Stephen, Lynn, Gwen, Deckard, Calgary, and all who got this ball rolling.
I’m just going to sit down and figure out what it would have cost me over the next two years to do U.S. forms on ZERO taxes owed and start donating from that perspective. I don’t have much but, I sure can find a way to make this work into our budget month by month.
I have tweeted this information and will do so every day including MP’s, the media and any and all expat organizations all over the world that I can.
That video was incredible! Thanks double for putting that together. Shows exactly the problems and who just voted to stand up for Canadians and who did not. Berg had no place being invited there.
Let’s get going. “There will most certainly be a Charter Challenge” They could have voted “Yes” for NDP six but, decided instead to push us to court. Dear cons, if you won’t stand up for Canada. We will.
Whitekat and others, I apologize for standing on my stool. Whitekat I appreciate the hard times. I will donate and cannot say how much for now. I just get excited about the prospect of going to a court challenge. Kermit
I just gave you $1k CAD. No idea what that is in real money.
I hope you guys win.
The best part of this is if it tanks the Canadian economy as the bankers say it will, I don’t actually live there to suffer!
My contribution is to honour my great grandmother who was 1 of 5 Alberta women who travelled to London England and succeeded in overturning a decision of the Supreme Court of Canada. The SCC had ruled that women were not eligible to be Senators in Canada. The Privy Council overruled and established the doctrine that the Canadian Constitution is ‘ a living tree ‘ that evolves and grows.
We will prevail if we can find the resources to carry on the fight.
@Duke Of Devon,
What a legacy you have! That is awesome! 🙂
@Kermitzi,
Hard times? Sometimes I feel guilty for how much I have. “Hard times” is all relative.
I appreciate your support, and am likewise excited to win this.

Is there any wonder, why a lot of people think Americans (even dual citizen American) are arrogant.
@GeorgeIII
I am not a duel citizen. In America and the UK we have these things called jokes.
Bravo! I will contribute too. I`m hoping that the opponents will see the fruitlessness of their attempt to thwart such an obvious breach of the Charter of Rights and give up…. earlier rather than later.
But if we think about it – with 7 million expats and many supporters otherwise – the financial goal should be attainable. ( If every one donated only 1$ we`d have 7 million to pay for this legal challenge! So hopefully the more people who know about this and help, the better!)
As an aside- who are all these strange new members with names like “youth thunder jersey”, “commercial coffee pots…” and “best harrogate cardiology expert” etc etc who are posting (adds?) on here?
@Polly – spammers. The website admins are always working on stopping and deleting the spam but sometimes they slip through. We are lucky that they are on the case or we could be reading one spam for every second comment!
@gwevil
So there are no actual people behind it?
@All
I just had a very weird thought. Our biggest enemies in this charter challenge are the banks – but the banks are just as much against FATCA as the rest of us- at heart. They are the ones who have been bullied into this situation. Wouldnt it be in their best interest if FATCA died too, globally? Shouldn’t they actually be donating to this cause as well, instead of opposing it? If Canada was actually able to topple FATCA- wouldn’t that actually be in the best interests of the banks too? Its mind boggling how we are pitted against each other, when the banks are really just as much a victim of FATCA as the rest of us and the rest of the world.
@Polly,
I agree.
If our Canadian legal challenge were successful in killing FATCA worldwide, the banks (in addition to all Canadians) would benefit. We expect the banks to oppose us in the courts, but we will be asking them for donations.
Is there the notion of a veto in Canada? Can the budget bill still be vetoed?
When can we expect it to become law?
Thank you to Lynne, Stephen and others. A cheque will be in the post forthwith.
For the organising committee, a suggestion:
There is a significant number of US-origin individuals working in Canadian universities, many of them with a personal interest in this issue. It would be helpful to make the initiative known to this group, for its own sake and to increase the funding base. One approach might be to get an interview published in the Bulletin of the Canadian Association of University Teachers (CAUT), which represents 68,000 university faculty and librarians across the country. I expect that easily 5 to 10 percent of this membership has US ties of some kind. I share this based upon my experience as a retired academic librarian.
Here is the CAUT website:
http://www.caut.ca/
For that matter, contacting the Canadian Medical Association makes sense too, as they certainly lobbied against FATCA implementation.

The bank would be happy if the Supreme Court ruled against it and the US government accepted the decision and did not impose the 30% withholding, If Obama imposed the 30% withholding on all transaction it would be devastating to our economy (no joke). It our main export market (we export hard to move bulky commodities) and far more Canadian invest in USA and travel to USA than are Dual citizens. It also would increase interest rates 1-2% think of this as a mortgage holder. The Federal Government in that case (3 major party) would probably impose the non withstanding clause.
There could be even a worse scenario for duals where Banks will not use IGA rule and start shutting down USA person accounts. They may be fined by Canadian government but it would be less than 30% withholding.
Thank you to all who helped set up the website and create the video. And thanks to all who are and will be donating their time to work on the legal challenge and the administration of it all. Excellent site, excellent video, excellent work.
My first donation has been made. I’m planning a fundraising and awareness event next week where I work, so I’m hoping to have more to donate soon.
Keep up the fantastic work!!
That’s an impressive video, and it should make good campaign material for whatever candidates run against those particular Conservative MPs in the next federal election.
My first cheque to support the Charter challenge will be in the mail today. I personally have nothing to gain financially from defeating the FATCA IGA, because I have a CLN attesting to my relinquishment of U.S. citizenship in 1979. But as a proud Canadian, I must support this challenge against the current Canadian government’s unconscionable surrender of Canadian sovereignty to the United States. I also hope for a day when a new Canadian government and the governments of other countries will challenge the U.S. along with Eritrea on their unique diaspora taxation.
I am in awe of all of you who have had a hand in organizing the legal challenge and the website. The video is exceptionally powerful. … Simply in awe.
Another thanks to all who worked so diligently to put the Challenge and website together.
Could “It’s time” be changed to a sticky so it’s the first thing people will see when visiting Brock? At least until the first phase of the fundraising effort is completed.
Kathy — good for you in carrying this forward with a fundraising and awareness event where you work!!! Excellent idea.
Polly,
Our banks could have fought this from the start — although they did write letters at the start, they came to see THEIR light and determined it in their best interests to instead they chose to funnel funds into making it happen. Sure, they are a victim, but that victim did not fight back. From listening to the financial industry representatives at the House of Commons Standing Finance Committee, they ain’t going to start now.
Duke of Devon,
You could not honour your great grandmother in a more meaningful way. She would be very proud that her spirit remains in your actions now. What can we now do in Alberta to bring this to the forefront of people who will be able to meaningfully contribute to the continuation of Canada as a sovereign country?
Bravo, Duke!
@Polly
As demonstrated repeatedly by Mr Hannah and Mr. Berg on the FINA videos, the banks would be forced to deal directly with the IRS if the IGA was not passed/we win. They seem unable to imagine that the prudent thing for the CDN govt to do, given they are well aware of the possibility we could win, would be to start now on developing a new strategy to deal with that. Prof. Cockfield has brought up NAFTA & WTO. Allison has brought up some of the Treaty issues to address. If course, a few countries could consider some backroom consultations though I have been told that I “do not understand how things work” with respect to that idea. Seems to me that is exactly how these guys operate when they want to hide what they are doing-The Border Action Plan, the IGA negotiations, going along with the NSA- what’s stopping then now? Just time to do it with some other partners. We may even get lucky and Mr. Bopp will succeed. I believe I heard one of the compliance guys say that even if the US attempt is successful, we would still be stuck with the IGA (!). They don’t seem able to think “outside the box here.” My guess is they have a huge stumbling block when it come to the concept of putting the US in its place and would fear being any part of such actions.
