The question of whether FATCA infringes the rights of a dual US/EU citizen hasn’t yet come before the European Court of Justice.
There’s a case being brought in France. If it doesn’t get settled at the national level, it might come before the ECJ.
Personally, what I’d like to see is a case brought by a US-born former US citizen objecting to being asked by a bank to hand over SSN.
The only reason for this demand is national origin.
Unfortunately, taking it to court would be expensive so it may never happen.
The fact is that all the European countries, bent over, spread their cheeks and blatantly signed this hugely lop-sided extortion “agreement” (FATCA) and basically became spies for the US IRS bullies. The us empire has NO friends–simply, interests (Dulles), and their interests are to extract money from their tax cows (“citizens”) for endless war, military bases, and hu$tling.
All European citizens and its’ feeble, mealy-mouthed governments (dual citizens, naturalised, native born, etc…) need to give the middle finger to the us empire.
