UPDATE January 24, 2015: THIRD OF FIVE LEGAL BILLS PAID

On August 11, 2014, Constitutional Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples worldwide. Read Alliance’s Claims and comment on our Alliance blog.

Ensemble, nous avons atteint notre but : ramasser les fonds nécessaires pour payer la troisième des cinq factures légales de notre poursuite judiciaire.
Ramasser 300 000 $ provenant de petits dons est un exploit tout à fait extraordinaire et nous invitons notre gouvernement canadien, ainsi que tous les autres gouvernements qui ont piétiné les droits de leurs citoyens, à en prendre bonne note.
Chaque jour, nous nous rapprochons de notre but. Déjà, nous avons ramassé plus de la moitié des fonds nécessaires pour payer les frais légaux de notre poursuite contre le gouvernement canadien et l’entente FATCA.
Si nous avons parcouru un si grand bout de chemin, c’est grâce à nos deux courageuses plaignantes, Ginny et Gwen, à nos donateurs provenant du Canada et de partout dans le monde, ainsi qu’aux administrateurs des sites Internet Isaac Brock Society et Maple Sandbox. Ils permettent tous à nos voix d’être entendues.

Dear Friends and Supporters,
Together we have reached our goal of paying off the third of five retainer fees for our Canadian FATCA IGA lawsuit.
Raising $300,000 from small donations is a pretty amazing achievement and we ask the Government of Canada, and those other governments who have also tossed away rights of their citizens, to take notice.
It’s still a marathon, but we are more than half way to pay off the Federal Court legal costs.
We have come so far because of our brave Plaintiffs, Ginny and Gwen, our Canadian and International donor-supporters, and the administrators of the Isaac Brock and Maple Sandbox websites who make it possible for our voices to be heard.

On information, the government wil stall, stall, stall.
On my simple request in March for copies of submissions made by Canadians, I asked in May if they would be provided to MPs. The answer was no.
I asked if I could receive them before my testimony. Request was denied.
In June, I asked for them before the vote was taken on the enabling legislation. Request ignored.
I received them shortly after the vote in June.
Here is what Canadians said on the IGA. Cons didn`t listen.

I sent these documents to the NDP, Liberals and Greens soon after I received them. None of them replied.
i do not know how anyone could read those submissions and support the IGA. Oh wait. Maybe no one read them or our briefs that are here:

But also, any action is welcomed to try and spread the word and encourage others to make a small (or not so small) donation. Do you have contact with other Aussies with “US Indicia” (or spouses or business partners thereof)? Maybe an Expat group (in general) in your community? Do you have acquaintances with children who have greencards and are working in the US? Or have become engaged to a US person when they were studying in the US? Do you know journalists or radio/tv folks? Do you know anyone with a business connected with the US? Have you tried to put “free ads” (such as Kijiji) up about FATCA and what is doing around the world?

We have never been called tax cheats and/or 2nd class citizens also… I will beg… shame… & push buttons so we can reach our goals… this is not just for us… but all others who have no representation… I don’t see any other lawsuit going forward… this is the only game in town that we must all participate in… We can all sit around and hope the Republicans can help or anyone else… but we have to face reality… we are the only ones who can try to stop this… the so call little people… if we all get together… world wide… they will hear all of us roar as we flip the US a bird for this crap they are doing with the help of our own home countries… the US has all our gov’ts on their payroll for free… Don’t forget… our own gov’t official said… Congress has spoken…. here is what we say… see u in court…
Either the government has 33,000 pages of defence, or the defence has to find support for what the government did within 33,000 pages of documents – kind of like finding a needle in a haystack, at best.
When I was looking at the ADCS thermometer earlier today, seeing it rise oh so close to the $70,000 mark, I found myself thinking of an old song and I ended up with this little paroditty.

And we need to meet them in Irish Courts, in British Courts, in Russian Courts, in French Courts, in Spainish Courts, in Greek Courts, in the EU Court………..
This indirectly pertains to the lawsuit. Just think of the sitting ducks US Citizens will be when there are databases of said persons along with address, spouse and children!!
If this can be hacked and published, how many US Persons will be targeted before FATCA is determined to be a security threat?

I ain’t too picky… any court… all courts… I would be quite happy if it was all courts… but I have a feeling its only going to be canadian court…
Regarding the conversation about courts … we won’t get to a Canadian court if the Sovereignty Thermometer doesn’t start rising faster … and soon! It appears we’re all rather shallow-pocket people but that only makes me prouder when I look at how much has been raised so far. We’re past the halfway point and that amazes me because, truth be told, the $500,000 sum seemed like an awfully big challenge when we started mid 2014. I have more to give and will do so gladly. I only hope we’ll soon see a pick up in donations, especially from those who are just becoming aware of the seriousness of this issue. Loss of security and privacy in one’s financial affairs is NOT acceptable and if it takes a court challenge to send that message to our government then let’s make absolutely certain it gets delivered by donating whatever we can to the ADCS fund.

Seriousness? How serious is this in reality? Well, lets see. The Us government now knows of the clear damage being done to anyone born in that country. Unless they have been under a rock, it is clear that they know. what is their answer? Nothing. yes, thats right, NOTHING! They seem happy to make NO official statements to those harmed except to raise the fee to renounce from 450 to 2350 US. That is clearly how despicable they are in regards to the human damage being done. Time and time again, they were shown exactly what the issues are for these poor souls who were born in the USA and only wanted freedom to live where they wanted to and be who they wanted to be. If that is not enough reason to donate. lets see…. how about the Canadian government’s response to our letters. Some of those letters were from Canadians pouring their hearts out begging for help to stop this extortion and enforce Canadian laws and protections that they were led to believe that they had. these people are law abiding Canadians who asked for protection. The answer was, a carbon copy response that answered none of the letters individually. yes, a garbage flyer type letter that worth less than the paper it was printed on and was sent 1 YEAR LATER after the damage was done. The dirty little deal was done without the Canadian public’s knowledge and now they forced it into law and we never had any say in it. Is this what Canadians want from their government? Is this what our taxes go for? Another donation in the name of EVERY SINGLE PERSON that has had their lives destroyed by this government’s actions. More to come!

Can you imagine an american like me who left the USA at the age of 7 years old in 1973 for England and then France in 1975 (God bless Charlie), living in France ever since, donating money to Canadians that are defending us US citizens living abroad for unfair and descriminating treatment from Obama’s gouvernment due to middle aged Citizen Based Taxation and FATCA ?
We must be living in some kind of fiction movie or dream, this can’t be true.
As the world has just found out from the attack at Charlie Hebdo in Paris, liberty and justice is an eternal fight.
How is it that US citizens abroad who should be proud and patriotic are giving up their US citizenship because of a stupid unfair tax law ?
