UPDATE January 24, 2015: THIRD OF FIVE LEGAL BILLS PAID

On August 11, 2014, Constitutional Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples worldwide. Ensemble, nous avons atteint notre but : ramasser les fonds nécessaires pour payer la troisième des cinq factures légales de notre poursuite judiciaire.

Ramasser 300 000 $ provenant de petits dons est un exploit tout à fait extraordinaire et nous invitons notre gouvernement canadien, ainsi que tous les autres gouvernements qui ont piétiné les droits de leurs citoyens, à en prendre bonne note.

Chaque jour, nous nous rapprochons de notre but. Déjà, nous avons ramassé plus de la moitié des fonds nécessaires pour payer les frais légaux de notre poursuite contre le gouvernement canadien et l’entente FATCA.

Si nous avons parcouru un si grand bout de chemin, c’est grâce à nos deux courageuses plaignantes, Ginny et Gwen, à nos donateurs provenant du Canada et de partout dans le monde, ainsi qu’aux administrateurs des sites Internet Isaac Brock Society et Maple Sandbox. Ils permettent tous à nos voix d’être entendues.

Dear Friends and Supporters,

Together we have reached our goal of paying off the third of five retainer fees for our Canadian FATCA IGA lawsuit.

Raising $300,000 from small donations is a pretty amazing achievement and we ask the Government of Canada, and those other governments who have also tossed away rights of their citizens, to take notice.

It’s still a marathon, but we are more than half way to pay off the Federal Court legal costs.

We have come so far because of our brave Plaintiffs, Ginny and Gwen, our Canadian and International donor-supporters, and the administrators of the Isaac Brock and Maple Sandbox websites who make it possible for our voices to be heard.

In their open and blatant attempt to create new democrat voters the democrats in the WH allowing amnesty to many millions flowing across the US southern border illegally with their blessing and taxpayers money create another class of takers who now most assuredly are more than the givers. This looks good to those who seek a better life , enticed with the promise of freedom to be able to come to the US and get jobs and the WH will make it possible for them to get much more. Free lodging, free schooling, free health care.
    With more than 92 million people out of work, 47 million on food stamps and logically these new arrivals also using the welfare system it turns people who are seeking a better life and desperate to find it into prisoners of economic reality: There are more takers than givers and the givers are running out of money and patience.
    Just as Margaret Thatcher said, “Socialism works until you run out of other people’s money.” The printing press that is the US Treasury and the Federal Reserve and the latest GOP Crominbus bill make it seem as though there is enough money to go around.
    When these new arrivals to US shores get their new found credibility created out of whole cloth by the administration , seek and find US Citizenship they will find that once they are they can go nowhere else on earth forever more, nay , nor their children, grandchildren without having to pay the US government for the privilege every year forever more. The freedom the US seems to represent is a trap and is indeed a coffin of liberty with the lid about to be shut tight while the rest of the world will pay with their financial futures without having ever stepped on US soil.
    This disaster is generational and will destroy nations untold and their people with them .
    UNLESS we fight NOW. HERE and NOW.
    When that first shot was fired on Lexington bridge, the defenders knew nothing but that they would defend themselves and their families any way they could.
    When young Isaac Brock ran into battle to defend his country he new nothing but he would defend his country and his fellow countrymen no matter what.
    THIS is the spirit that fuels the resistance that IS the lawsuit for the sovereignty of Canada and the freedom and rights of the people within her borders. For without it we will cease to have borders.
    Without borders no country can survive.

  3. What a moving letter in the UPDATE today. I’m going to paste it below so it doesn’t eventually disappear. Someone was reading my heart and putting words to my thump-a-thumps.

    A DONOR SAYS:

    “There is a paralysis that sets in when you feel helpless to change things.

    Donating does give one a very small degree of control and the sense that you are taking some sort of action rather than just getting run over by the U.S., and the Harper Government (which I do not equate with Canada). At least this money means that a little less that the IRS can steal from us down the road.

    So many more need to step up to the plate and help themselves and one another.

    We truly must give until it hurts. It’s the only way we can hope to get our lives back.   5. We’ve come a long way, baby!!

    It’s just like the December solstice we’ve just passed — now each day will get brighter and we will better be able to see that our goal is within reach. As Stephen says, “inch by inch” we’ll get there.

    Congratulations and sincere thanks to ALL of you who continue to loyally support the Canadian litigation — fellow Canadians deemed US citizens, along with their non-US family members and our friends from around the world (those who have been able to claim relinquishment or have renounced; those still US-defined US citizens, accidental or otherwise, and others who recognize the injustice of the Canadian legislation that enables US FATCA law to override Canadian laws, including the Canadian Charter of Rights and Freedoms). This fight is critical for ALL of us and for our children.

Help defend Canadian sovereignty and our Charter Rights and Freedoms, as well as striking a blow against the injustices of FATCA and CBT forced on those living outside the US. Protect us from usurpation by the US predator reaching over outside its own borders and jurisdiction, with greedy talons laying claim to the lawful local savings of Canadian and other families.

    Thanks to all the many who contribute in so many ways here. IBS was a gift of information, solace, support and company back in Christmas of 2011, and continues to be a gift that keeps on giving to all of us.

  8. Fight against the FATCA IGA as an extension of the US extraterritorial criminalization of our local, and lawful voluntary and community activities:
    For example;
    US citizens and non-citizens residing inside the US can join clubs, professional associations, volunteer, be a board member and otherwise participate in governance activities in their communities – as volunteer Board members, treasurersor fund-raisers (which commonly come with co-signatory responsibilities), but US citizens living outside the US are prevented from certain community and voluntary and professional activities – UNLESS they want to take on the personal burden of reporting (and potentially being penalized or audited) on the accounts of others.

    Here is FAWCO’s guide to the FBAR for those who have to report its club funds to the US as if they were their own – based solely on their US citizenship status – though the FAWCO funds are legal, local and subject to the full layers of the laws of the country where they are lawfully originating and held:

    In many small community organizations, with 1 or very few staff members, it is common to hold co-signatory powers over the organization’s accounts – as it is also for a voluntary Board chair or member, For the staff or volunteer it is a mandatory part of the job. The US then is preventing those living outside the US from being able to work or volunteer in the charitable or voluntary sector in our communities because our local non-US organization would have to agree to allow the reporting of their accounts (usually sourced from Canadian government, provincial or municipal and charitable donations) to the US Financial Crimes Network (on the FBAR).

    Who wants to voluntarily take on additional liability which would penalize them based on the highest balance in the accounts of their community, charitable or social work as well as their own and their family members, in terms of the FBAR burden?

    The US thus criminalizes our work and our community and voluntary activities.

    The 10,000. threshold set in the ’70s has never been adjusted upwards to account for inflation. Including non-personal accts such as the ones described above merely makes the FBAR an even more egregious assault on those living outside the US whom the US claims as citizen-serfs.

    Donate to the ADCS in the name of the freedom to associate, and to participate in these important roles without US extraterritorial interference in the community and social activities of Canadians and their counterparts elsewhere around the globe. The ADCS is geared to defeat the forcible imposition of US FATCA law on Canadian soil –

    Remember, FATCA has been called the Son of FBAR.

    That may the cheeriest thing we see on Brock today. What a sad change from last Christmas when we could still laugh (a bit) about the situation. Thanks for all you do — that we see and that we don’t see. I don’t know how you do it but I pity the keys on your computer keyboard because they must take a heck of a pounding, particularly when you find yourself typing with that middle finger.

Thank you to Gwen and Ginny for becoming Canadian Heros who will go down in history for the country you love… Canada. Thank you to everyone here at Brock working tirelessly and keeping everyone informed and educated. I will say this… you have no idea how many lives you have saved, you have no idea how much comfort you have brought to Canadians and you have no idea what you mean to us. This does no go unnoticed here and around the world. My mother passed away 3 days before Christmas and we are grieving here. She was fully aware of this fight for my family and my wife. She always supported me and brought me up to be honest and to care about others. My future donations will have part of her estate as she would have supported my family and this is a way she can. Merry Christmas everyone and we are thinking of you!

  13. I am posting this here as a comment so that it will be archived. It was written by one of us, on Christmas day 2014, who was reacting in part to the news that the Vatican has sadly decided to work out a FATCA “deal” with the United States:

    “At the end of the day the CBT/FATCA issue is apolitical. It is about the foundational principles and values of a nation.

    It is Christmas Day and I sit contemplating how the United States can justify viewing itself as a Christian nation. If there were ever a circumstance where the Democrats and Republicans could rally around one issue united in the love for their country before their party it is this one.

    As I reflect on the spirit of Xmas I see the US has also extorted the Holy See into signing a FATCA agreement. The pope’s admonishment of the Vatican bureaucracy for succumbing to a “catalog of illnesses including “spiritual Alzheimer’s” and “existential schizophrenia” should also be directed at the US government.

    One would think if Pope Francis truly understood what was going on here he would have the courage to inform the US of its violation of three of the Ten Commandments:

    1. Honour thy father and mother. FATCA and CBT are in complete violation of the principles of the founding fathers and mothers. A revolution was fought over these very same atrocities when inflicted upon them.

    2. Thou shalt not steal: FATCA and CBT are stealing assets from individuals that get nothing from the US nor expect anything. They are also stealing assets from other nations economies and extorting banks world wide to accomplish this theft.

    3. Thou shalt not covet thy neighbors goods. The US is not entitled to the earnings and savings of anyone that does not live in their country and receives no benefits from them. Stealing from the tax deferred accounts of disabled children renders the violation of this commandment all the more heinous.

    Note to Pope Francis: Make sure there is no one with both fiduciary responsibilities and a US indicia handling your accounts. The US will bankrupt the Catholic church in FBAR fines.

    Somehow the US still refers to itself as a Christian nation, go figure.

She raised a valiant and caring son so there can be no doubt that she was an extraordinarily good person herself. Hold close and carry forth the spirit of that steadfast support she gave you and your family.
