See the U.S. Constitutional analysis of FATCA article Neill has found.
Any comments?
From the document:
“…The FATCA reporting requirements arguably resemble that of a general search warrant. It was enacted in order to curb tax evasion of U.S. citizens using foreign accounts.
However, while the information reported can be useful to the IRS in confirming the income reported by individuals, there are no particularized suspicions in collecting this information from every foreign U.S. account.
Doing so assumes that every U.S. citizen with a foreign account is a “crook” evading his taxes.201
Additionally, the searches at hand contain the potential for abuse. This is due to the “access to this information without invocation of the judicial process.”202
The scrutiny of a neutral magistrate helps to balance societal and individual interests in the collection of the information at hand.203
Without a warrant issued through the judicial process, the search is an unreasonable violation of the individual account holders’ Fourth Amendment rights…”
I’m thinking that after yesterday’s news about the FBI raid, Trump will want to get rid of FATCA to protect Manafort. And probably the family business too. So this could all work out to our advantage.
I think he meant suborning, which is what anyone who aides another in criminal activity is doing. The U.S. has in many way strayed from being a country of laws that apply equally to all citizens no matter where they reside. These recent leaders are not believers in the rule of law and that we are endowed by our creator with the rights laid out in our founding documents, but that we are sheep to be shorn and the wool given to whomever they deem worthy of getting the fruits of our labor. Expats are just more sheep to the IRS, which would have been unconstitutional had the Russians not sent a large army to our shores even before they took over Russia, to make us socialist. I know of what I speak because I was on the inside of their push to subvert the U.S.into socialism. These were all followers of Marx,Engels,Lenin,Stalin and Trotsky who fanned out and got our founding document amended to permit what our sacred founders had prohibited . If we don’t trash the entire Tax Code, of The U.S., all citizens will become property of the despised IRS and will do their bidding or loose all their assets. We need a new Tax system, not reform of the one we have. Doing anything to try and fix our tax code would be like putting whipped cream on horse puckey and calling it a deluxe desert.
Ask any of your lawyers if a TaxPayer abuse case will ever reach SCOTUS and any knowledgable lawyer will simply laugh. The IRS has a bevy of lawyers to tell them when to fold on a case to keep any taxpayer rights from making it to any level where it becomes adverse case law.
The fight will have to be fought in the U.S. House and senate, but the current bunch are bought and paid for by the Tax industry who go to work warning their ”bought and paid for” rep to stop this nonsense of voiding the tax system and going to a simple revenue system envision by the founders who said taxes should be from tariffs and excises, meaning a sales tax. Wise men founded our system now run by greedy fools.
“I think he meant suborning, which is what anyone who aides another in criminal activity is doing.”
I mean it is illegal for one in authority to coerce or in any other way have a subordinate commit a crime on their behalf.

So what do we do?
When it is long yardage and 4th down—PUNT THE BALL____ Then get rid of the whole dam bunch and start over. Trump is a populist who wanted desperately to change the system and even has advice and council of Governor Huckabee, a staunch advocate of the founders idea of a tax on all sales , but the swamp creatures ,democrat and republican are ”slow walking him to the end of his patience and he will just say screw it an walk away. He wanted a world where hus grandchildren didn’t have to endure fools, but alas the fools appear to have won.
@Wilton up here in Canada we have three downs and a bigger field…and to quote the CFL ad from a decade ago. “Our balls are bigger.”.
I also have a new acronym for FATCA (at least for Canadians) Fucking Americans Taking Canadian Accounts
Bravo, I love football and the football difference between Canadian football and American Football League rules. I write about the despised IRS a lot and so far the audits are small annoyance. But any day I expect a knock on my door. I am an advocate for the U.S. constitutional taxation set up by men I consider devinely inspired and all the rest we have now doing the devil’s work. If I say the kind of tax I favor they will use the computer and drop my comment without publishing any of it. So I will simply quote the U,S. Constitution on tax sources. Washington, Jefferson, Madison, and Hamilton, all said taxes should be from excises and tariffs. meaning a sales tax and a tariff on imports and never on income. The communists lied and got our precious document amended and since then the unelected 4th unconstitutional branch of government have terrorized most of us, except the half plus one who pays no taxes.
Japan T. Now you are getting the picture. Every congressman and every senator is a paid handmaiden of the Marxist Income tax system. They call it Campaign contributions, but it is a bribe and calling it a duck won’t make it quack.
Thanks but I have long thought simular. My questions is, what do we do about it? Break out the ploughshares and hammers to beat them into…?
There is an organization gaining members every day but if I mention the name on this site they won;t accept the comment at all. I will simply quote the Constitution. Taxes are to be raised by tariffs and excises and never by taxing income. So How do we tax incomes. The Eastern Europeans came her and got our precious document altered by teaching ”hate the rich” and take their wealth with the method Marx asked for in his Manifesto, second chapter. A progressive income tax paid by over half the population. There are millions of people making a good living filling out form that are mostly not looked at. A national sales tax is an excise and tariffs are placed on all incoming goods and tat should be all we need. I think I have doomed my post by advocating changes in the law and mentioning Marx and his plan to destroy the middle class with taxes and debt.
“If any of them did what their oaths demand they do we would not still be fighting this war, now almost twice as long as WWll !!!”
Unfortunately the following is true, at least in the USA:
“Most of the people in Congress, our elected officials, don’t understand the Constitution or even know what it says, even though they take an oath to uphold it.”
– Judge Andrew Napolitano

The US constitution includes its 16th amendment. That’s not the problem most of us have to deal with.
It is of great concern that we are governed by such ignorant people. We don’t require that our representatives be familiar with the constitution. They are mostly Lawyers who call lying by some other name.I have heard many different terms for lying. The latest is mischaracterizing something or restating white to be something other than a color.
A test to see if we are competent before we can run for any important office.
There’s a little bit of testing before running for office, but it doesn’t matter. The big test is the election. When voters give a passing grade to an idiot or criminal, the idiot or criminal passes the test.
If there had never been a 16nth amendment, there would never have been an Income Tax, which the founders wisely prohibited. It was, without a doubt , a Russian component, that was sent all over the world and especially the U.S., to suborn socialism, that nobody yet knew the evil of. They knew only lying and treachery and they used all their lies to get the 16th passed. They said it would only be paid by the evil rich. It would never be more than 2%, now we know they knew better, so now the whole camel is under the tent when his nose was all we thought we’d ever see..Yes you do need the help get rid of that amendment and go back to prosperous growth.
You are correct. The voters who once had to know the bill of rights before qraduating from high school now run for office and win without any civic knowledge.Civics are not taught as a subject jn any school.
Well, if income tax was only supposed to be paid by the evil rich at a rate of 2%, then proletariat suffer now because the income tax LOST its Marxist character.
But that’s still not the problem of most of us. Double taxation, incredibly complex reporting that’s impossible to perform correctly, penalties for honesty, etc., uniquely persecute America’s diaspora. That’s why we have to stop being America’s diaspora.
By the way I had thought income tax was invented in the Roman Empire, but I was wrong. They had a wealth tax. You didn’t just pay when you earned the wealth, you paid over and over and over again. But they invented something else that America copied: heavier taxes on their diaspora than on their homelanders.
“Double taxation, incredibly complex reporting that’s impossible to perform correctly, penalties for honesty, etc., uniquely persecute America’s diaspora. That’s why we have to stop being America’s diaspora.”
Without the 16th admendment, none of these problems could exist.
We are the new Roman Empire. The English language and our troops stationed all over the world are the new Centurians. Keeping the peace is their stated job, but it may be the opposite.
“Well, if income tax was only supposed to be paid by the evil rich at a rate of 2%, then proletariat suffer now because the income tax LOST its Marxist character.”
Well, if the original intent of the Constitution was not lost, we wouldn’t this group.
“Double taxation, incredibly complex reporting that’s impossible to perform correctly, penalties for honesty, etc., uniquely persecute America’s diaspora. That’s why we have to stop being America’s diaspora.”
‘Without the 16th admendment, none of these problems could exist.’
That’s a non-argument. Without post offices the US wouldn’t have been able to tax its diaspora for 100 years, and without the internet the US wouldn’t have been able to tax its diaspora for 20 years. Do you blame post offices and the internet, say they shouldn’t have existed or should be disposed of?
“Well, if income tax was only supposed to be paid by the evil rich at a rate of 2%, then proletariat suffer now because the income tax LOST its Marxist character.”
And this is not a non arguement?
Not exactly, Last year only 47% of the working age population paid income taxes and nearly 90% of the taxes were paid by the top 2% of the population. There were an extra 40 million tax returns filed in order to claim a refund called the ”earned Income Tax credit”. So Marxism is alive and well.
We need every resident to have a stake in the game. Nothing like paying for the benefits given to others, to wake you up.
