[This post, which began in May and having over 1000 revisions and 2000 comments, is being retired from service and updates. It lived through the success of reaching a total of $500,000 in donations from our kind, dear supporters who had little money to give, the hope and disappointment with the summary trial decision, and the certainty that we are now finally moving on to the Charter trial.]
CANADIAN CHARTER TRIAL UPDATE:
— We have instructed the Arvay team to prepare for the “Constitutional-Charter” trial. This means that our focus now, as it was in the beginning of our lawsuit, is on the Charter trial.
Unless there is a new expense in the future that we have not anticipated, the monies from your donations will be sufficient to take us through the “constitutional-charter” trial in Federal Court. However, to pay other legal bills we will need additional donations from our supporters, and a request for donations will appear on another post soon.
OUR LITIGATION HISTORY:
One year ago, on August 11, 2014, Litigator Joseph Arvay filed a FATCA IGA lawsuit in Canada Federal Court on behalf of Plaintiffs Ginny and Gwen, the Alliance for the Defence of Canadian Sovereignty (en français), and all peoples.
Because of a Government delay we initiated a “summary trial”, using a portion of the arguments, which offered the possibility of preventing private banking information from being turned over to the IRS before September 30, 2015. Ginny, I had to stop drinking…FATCA took me over the edge drinking wise and I had to stop. But I do still think in thiose terms and I am not judgemental on those that do like to drink. When you came up with bingo…I started thinking this court case could have been a drinking game and some folks would be pretty hammerred by now.
ROY BERG is the ultimate compliance vulture and traitor to expats. He deserves nothing less than being tarred and feathered and tossed back across the border like the sack of shit that he is.

I hear you. And this is the part that the USA and other governments don’t get: the harm, the fear etc. All the consequences, intended or otherwise.
That’s why we are here together so we can fight for all of us, so affected. That fight is what keeps me and Gwen going.
Imagine, the Feds didn’t even feel we were important enough ( since we represent all others so affected) to even cross examine us.
Their loss. The two of us did have a lot we wanted to say to them, as you can imagine.

Re transcripts, it would be great if someone could look into that. I seem to recall from a trial some years ago where I testified as a witness that transcripts could be purchased for something in the low hundreds of dollars, but I’m not sure about the Federal Court. I would argue that full transcripts of this case will serve as an absolutely vital template for future cases in other jurisdictions, and hopefully that has already been factored-in to the legal costs we’re all contributing to. If not, then we should make it a priority to obtain them through our fund-raising efforts. This is part of our history now and we need to be able to share it with others – as well as preserve it for future generations.

USP’s in Canada first have to report their income in order to exercise tax credits to offset US tax. FATCA helps with those who don’t want to do that voluntarily. All in the spirit of cooperation, of course.
